People in positions of authority take punitive action when they are afraid. Most positions of authority today are occupied by extreme to moderate leftists. The students involved struck fear in the leftist power structure so a leftists lashed out.
Well, the Constitution is generally pointed directly at the feds and not at states or individuals, unconstitutional SCOTUS decisions and federal acts notwithstanding.
The state is subject to the vote and will of the people of that state and if allowed, has every right to act in accordance with its own laws both within the state government itself or otherwise.
It’s funny the moral outrage against ‘racism’ is only ever applied to White people. It is only White people would feel shame over it; do you think Blacks, etc. care about charges against them of ‘racism’?
In a sane country this fraternity (think of the origin of that word) would be able to exclude who they liked. The use of a crude racial identifier would be seen as distasteful by many, but otherwise not cause for outrage.
SAE’s were a bunch of pigs when I was in college at FSU and the DELTS were the prissiest sorority on campus. I see not much has changed. LOL! But free speech is free speech and in reality how many blacks would even want to join SAE or whites for that matter. :-)
This outrage, fake or not, brings to mind the session at Rev. Jim Jones’s People’s Temple and the old Soviet Union.
Nevertheless, it is the precedent that applies in cases like these. We can try to get it overturned, but until it is overturned by another case, the Bill of Rights applies to state and local governments as well.
Does the University tolerate on-campus Palestinian hate groups? Does it allow leftist student groups to shout down conservative speakers? Most universities do these days... it’s only the unPC who need to fear.
You have the state nullification option which barring constitutional amendments that the feds would have to implement (fat chance) is the only way the people can begin getting their country back.
Just put them on double secret probation.
This should be a pretty good payout. Just the violation of their civil rights will bring over $100m.
Is it legal to expel them for public loutishness?
If every college student who uttered a racist statement, black or white or other were expelled today....there’d be a whole lot of vacant space in our colleges...
The students entered into a contract with the school. The school does not want to find itself in breach of contract. Did the contract say anything about speech?
What part of the constitution applies? Which constitution?
The marked lack of a "Noble Cause" clause to keep others from being punished for offending your sensibilities. That's the part of the Constitution which applies after one accepts the freedom of speech amendment.
