Trial lawyers want to drug test California doctors

California has turned itself into something of a joke over the years in large part because of their Rule by Referendum mentality. A sufficiently large group of people – and really not all that many – can get just about any idea that crosses their minds onto the ballot and have it enacted into law with a slick enough sales campaign. There are in excess of 100 of these proposals facing left coast voters this year, and one of them – Proposition 46 – seems to be pitting doctors against lawyers.

I was thinking about drug testing for the jury but that would really limit the jury pool.

Pilots get randomly tested, some cops do, bus drivers get randomly tested, so why not doctors?

If anything, random drug testing of doctors should end up reducing incidence of malpractice and that should end up reducing costs when malpractice insurance rates drop. And upping the maximum libility is a means to encourage the insurance companies to make sure their doctors pass the drug tests.

Bottom line: Passing this law will have no effect on the doctors who are sober when they’re treating their patients.

I’d vote for it if I could.

A human is a complex biological entity that cannot be examined without a multitude of factors that affect the outcome of the case. If the patient is lost, lawyers sue the doctors for malpractice. Let’s use the same standard for lawyers. A case handled by the lawyers is lost, would not that be incompetence since they didn’t win using the same standard hoisted upon physicians? If the lawyer hadn’t been substandard, the lawyer should have won the case.

If you really want to improve society, drug test voters. Drug test welfare recipients. Drug test anyone on government payroll. Leave the people in private practice alone to make their own rational decisions on whom they buy and sell services and goods.

Not ridiculing you but you've highlighted the problem. Too many people here do vote for these because in the commercials it sounds like a good idea. If you do a little research, like reading the article in the original post, you would find out this is the trial lawyers trying to increase the limit on malpractice lawsuits. Do you really think the trial lawyers are trying to protect you from drunk or high doctors? How often is your doctor drunk or high when you go to see him?
