Of course it depends on the evidence. That’s why I advocate a hearing of some sort where it is diligently presented. Self-defense claims, in particular, would be a kind that might appear to provide an avenue to murder for an unscrupulous person. So, the evidence must be systematically investigated and presented at a formal hearing in any self-defense claim.
