If they are doing what they are supposed to be doing, then they shouldn’t even get to the self-defense argument until such time as they have satisfied all of the elements of Murder or Manslaughter beyond a reasonable doubt. If you don’t have the basis for the charge to begin with, the defense is irrelevant. Of course they could completely ignore all of that, and do whatever they want.

By asking for clarification, they are signaling that they want to be seen as very diligent, and to cover themselves...especially against reprisals.

Reasonable doubt exists in vast amounts, regarding any charge—so vast that self-defense simply cannot be disproven.

The only way Zimmerman is not completely acquitted is if there is a deliberate, conscious decision by the jury to go against the law and their instructions.

Question:

How can the judge “permit” the jury to consider a lesser charge of manslaughter? Isn’t that an arbitrary and capricious act on her part or is it permissible under Florida law?

a point of clarification (just jumping in, sorry if already covered earlier)

If the jury were organized in its deliberations, would it not first determine if the act satisfied the lesser of the two charges — that is, manslaughter? and then go on to consider murder only if manslaughter were satisfied.

the instructions list the charges in decreasing severity: first, murder, then second, manslaughter.

so the jury instructions would seem passively to encourage unorganized thinking.

if the jury first considers murder, and acquits Z, then if the jury next considers manslaughter, a lurking M sympathizer would jump at the chance to convict, claiming manslaughter a reasonable compromise. However, this would be illogical if the elements of manslaughter were included in the elements of murder.

Two of the witnesses in this case, both young males, could have intervened and prevented the need for Zimmerman to shoot Martin.

Zimmerman, screaming, begged eyewitness John Good to come help him. Good, watching from only 17 feet away, replied to Zimmerman that he was calling the police instead. Zimmerman screamed that the police were already on the way—that he needed Good’s help. Good could have knocked Martin off Zimmerman and stopped the deadly confrontation just by putting himself a bit at risk, but no, he didn’t want to get that involved, just like Kitty Genovese’s neighbors didn’t want to get involved.

There was another young male witness in this case, who told his wife, “stay away from the window, don’t look out, we don’t want to make this our problem.”

You get my point.

Zimmerman’s neighbor Frank Taffe just said on FOX that he had information that it is 5-1 for acquittal on manslaughter, and that the 1 juror was asking for clarification on manslaughter instructions.

I suspect the lone juror is the one who is termed “black or hispanic” by the media.

Could someone please explain the jury schedule?

How long will they deliberate tonight if no verdict?

If they don't reach a verdict tonight will they deliberate tomorrow (Sunday)?

Seems to me that if the Jury is 6-0 for acquittal on the 2nd Degree Murder charge and hung on manslaughter then Zimmerman walks and it is over. No re-trial.

Correct?

And given the Jury’s question, this is a reasonable assumption.
