It’s not the USSC’s problem that this legislative mess didn’t include the severability clause. Striking down the entire thing, which through haste and political pressures has introduced a pandora’s box of nightmarish legal, execution and funding problems, would be the cleanest way to deal with it. Simply dispatch the loathsome hydra. However, it will more likely be a matter of declaring the mandate unconstitutional and letting the political process resolve the resulting mess.
