According to the transcripting the dispatcher asked him if he was FOLLOWING, to which he said yes. I didn’t see anything about “pursuing.”
That may seem like semantics but in a legal venue, if I turn on the lights and sirens of my police vehicle and go after a vehicle or person with the intent to capture or stop them, I am pursuing.
If I am just following them around the neighborhood because of suspicious activity, that is all that it is, following.
Not pursuing, not stalking.
Here is another people thing are forgetting to look at. Zimmerman said in his call that Martin was acting suspiciously, then started walking toward HIM with his hand in his waistband.
This is a common thug tactic to intimidate people into making people think they are armed. Or it could have been Martin playing with himself, something thugs do often in public.
Either way, it further aroused Zimmerman’s suspicions and when Martin ran, Zimmerman followed. If he is guilty of anything, it’s not being a coward.
Having said that, one of the first things you have to train new cops is don’t be in too damn of a hurry to chase people off into the dark. Gang members have used this tactic to kill officers by separating them from their partners and laying up an ambush, sometimes even coordinated ones.
Zimmerman was no police officer, surely, but he is/was not going to let the usual suspects take over his neighborhoods like so many have in the past.
