EPA's Gun Control
IBD Editorials ^ | August 26, 2010 | Investors Business Daily staff

Regulation: The U.S. Supreme Court says Americans have an individual right to keep and bear arms. The EPA says the bullets for those guns may be banned as an environmental hazard.

The endless power grabs by the federal leviathan know no boundaries of law, science or even common sense. The Environmental Protection Agency of Lisa Jackson is seriously considering a petition by the Center for Biological Diversity, a leading anti-hunting group, to ban all traditional lead ammunition under the Toxic Substance Control Act (TSCA) of 1976.

If the EPA approves the petition, the result will be a ban on all ammunition containing lead-core components. Bullets made of material other than lead are often considered armor-piercing by law and are banned. So this amounts to gun control by stealth. Where permitted, it increases the cost of gun ownership and use.

The comment period on this proposed ban has just opened and will last until Oct. 31.

The EPA must accept or reject the petition by Nov. 1, the day before the midterm elections. As if Democrats don't have enough troubles, the Obama administration risks provoking all those townsfolk bitterly clinging to their guns.

There are a couple of problems, the first being that when Congress passed the law it specifically exempted ammunition. So what the EPA proposes to do is illegal. The second is that there is no scientific basis for restricting lead ammunition on the basis of protecting the health of humans or wildlife.

1983 civil rights violation lawsuit against every person involved in that mess. They want to do this, fine, see you in court. Oh, and to the punks doing this, you do know that it’s your PERSONAL money that is at risk... you can’t hide behind your job with a civil rights lawsuit.

Think hard on this EPA... We will come for you in the worst way through the courts.

Lisa Jackson must go. The EPA must go. Neither are compatible with American freedom.

If the EPA doesn't manage to make this stick, it'll just be something else they or another agency try to do in order to avoid facing up to the SC decision that the Second Amendment is an individual right rather than a gift from the government. The Education Dept and the EPA have to go. Anything worthwhile that they do can be done by a smaller, new, limited, replacement, one that is created with sunset provisions in their charter. Once those two are gone, we can start working on others and on shedding about half of the Departments and Agencies we need to keep.

Regards

DITTO. You are a rare freeper/conservative who advocates using the courts (something many conservatives loathe) to fight liberals. I think conservatives will be more effective because most of the time we will be advocating court cases that are backed by the MAJORITY of Americans vs most liberal cases which seek to to use the court to overturn the will of the majority.

I assume that this would apply to the US military? If not, then the revolution will not be far off...

Without guns, what is the military supposed to use, spitwads?

The EPA is treasonous and traitorous to this country.

And so is the DOJ for allowing it to happen.

And so is Obama for being the enabler.

They are all traitors.

1st step of many for Obama to take away our guns and ammo.
Wait until you go to your Dr’s Office. Because all medical records are being put on record electronically, you now have to fill out a medical history form. Questions on the form include, but are not limited to, DO YOU OWN FIREARMS?
I told them at the Dr’s Office to kiss my white ass -
I am not answering those questions!! I hope and trust all Freepers will do the same. This Obama is a danger to our freedoms - all of them!!

We must stay within the confines of our Constitution though the Liberals do not out of contempt and hatred. Believe me, if things go so bad that we have to pull the trigger on a gun or worse, our nation will be too far gone for it to matter.

We’re getting close but we can yet still turn away from the edge. I’d prefer to resolve this without bloodshed. But if the Liberty Tree must be refreshed, so be it. We won’t start it, but we’ll damn sure end it.

Good article on the express exemption (well, OK, it's "express" but hidden in legalese) of amunition from the EPA's authority under the 1976 act: http://mainehuntingtoday.com/bbb/2010/08/26/does-epa-actually-have-authority-to-ban-lead-ammunition/

In other words, if they try this, it will be lawsuit time. A slam dunk lawsuit, at that.
