Judge Lamberth has granted my request for judicial notice of the opinion in Fl, where judge Vinson has stated that as a Doctor of Dental surgery I have a legitimate interest in the subject matter of the Health Bill- this is a good sign.

Judge Lamberth has also denied Obama’s motion to dismiss as moot."

I’m not sure about Judge Lamberth. My post from 1/17/08:

Lamberth’s been in the news at least a couple of times:

The internal debate at the Justice Department and F.B.I. over wiretap surveillance of terrorist groups ignited in March, prompted by questions raised by Royce C. Lamberth, the chief judge of the Foreign Intelligence Surveillance Court, a little- known panel that decides whether to approve Justice Department applications to permit wiretaps and clandestine searches in espionage and international terror cases.

I am for Orly. I want Obama to prove his NBC status, and if he does, then so be it. But if he doesn’t...

He can't. It's a little bit hard to get rid of a Kenyan father. The minute he walks into a courtroom, he's outta the WH and he and his minions know it.

I am posting this to myself, because I don’t want to make anyone angry with this post, but I am going to go out on a limb here and say in public that I personally do not believe that Drew68 or Parsifal are trolls, and they are not intentionally trying to irritate those who question Obama’s eligibility, of which I am one.

Both of these gentlemen see this issue from a different perspective. Parsifal is very well versed in legal matters, and he does not see case law that advances our position. rather, he sees specific case law that would hinder such an inquiry. Furthermore, he is bothered by good people being sucked into this thing and putting themselves in legal jeopardy if I am paraphrasing correctly.

Drew68 sees this issue from the viewpoint of how to make conservatism succeed, as opposed to trying to win on an issue which would essentially be a “do-over” where we as the electorate would not have learned any lesson from electing wealth redistribution type politicians. If I am paraphrasing drew68’s position accurately, he believes that short circuiting Obama’s presidency will just lead to the dems selecting a similar type of candidate, but one without the eligibilty concerns, and then that candidiate would be elected by the same type of voter who elected Obama.

As a birther, and as a person who openly challenges Obama’s eligibility, I personally believe that both Parsifal and Drew68 have valid and well reasoned opinions, and I respect them both.

According to the CDC’s Vital Statistics Report for 1961 (p. 157), Hawaii had a total of 17,578 births in 1961
Note the difference between column 1 & 2
Honolulu county:
1 - 14,874 total births by county of occurrence

2 - 14,906 total births

4 - 92 attendant not in hospital and not specified/recorded

again, this is only 50% of the totals for 1961: Data refer only to births occurring within the United States. Based on a 50-percent sample

If someone is a conservative, and considers the Constituional eligibility unimportant, they will spend their valuable time fighting 0bama on other fronts, rather than spending their time attacking freepers who are doing this job.

No, I have that one. It was a similar set of data - a chart with a blue heading - more clean and digital, if you know what I mean - maybe census related. Basically proving the same thing about the number of births not matching with the newspaper announcements. Sorry, it’s my own fault for not keeping up with it. Thanks though for getting back to me. And big THANKS for being such a great help in all of this.

Tea Party headliner Orly Taitz cancels

 The controversial Orange County attorney best known for leading the “birther” movement is no longer headlining today's Tax Day Tea Party in Palm Desert.

Orly Taitz, who gained notoriety for challenging President Barack Obama's citizenship, has a “scheduling conflict” and cannot attend, event organizer Christina Michas said Wednesday.

Taitz, who is running for California secretary of state, did not respond to an e-mail request from The Desert Sun Wednesday.

It was not known what other event conflicted with today's rally, which has been advertised for weeks.

According to The Los Angeles Times, organizers of a similar Tea Party rally being held today in Pleasanton rescinded their invitation to Taitz after “getting calls from candidates like crazy” and she became “too controversial.”

The MTD by the AG lawyers was deemed moot because nutjob Orly filled a amended complaint (due to errors in her first motion) that the AG now has to respond to.

The AG has already filed a motion to dismiss the amended complaint. You can read that here.

People are misunderstanding the significance of this ruling. All Judge Lamberth did was to dismiss, as moot, the original motion to dismiss the original complaint. He dismissed it as moot because (a) Orly filed an amended complaint; and (b) The AG's filed a motion to dismiss the amended complaint.

Therefore, the contention that the judge declared that the case is "not moot" is just wrong.

In short, the AG's amended motion to dismiss (and opposition to motion for preliminary injunction) is still on file and Judge Lamberth will issue a ruling on it. Probably soon.

Standing: Wouldn't this be weird: While Orly the "lawyer" has been found to have "no standing" in court, Orly the "dentist" is found to have "standing" in court.

If Orly the dentist is found to have standing in court, as I said, that would be weird indeed.

Weirder things have happened, but it really doesn't matter who gets to the discovery phase in court, as long as it happens. I was listening to Peter Boyle this am and Hannity is going to pick up the subject also. Margaret Henenway, the spokesperson for LTC Lakin is working out the details to be on his show and O’Really is going to discuss it tonight with Megyn.

That’ll be interesting
