ACORN dumps documents; Breitbart has them and will release (Retreived from Dumpster!!)

Following the release by Breitbart's Big Government website of a video showing employees at ACORN's San Diego County office offering to assist in the transportation and exploitation of underage prostitutes from abroad, the Attorney General of California announced an investigation into ACORN's operations. Nights before the visit, ACORN dumped thousands of documents in a dumpster. Breitbart obtained them, says they are shocking evidence of ACORN's illegality and promises to release them bit by bit over time:

Documents shared with BigGovernment.com include information exposing not only the inner workings of ACORN in California, but also personal, sensitive information belonging to employees, members and clients of ACORN. ACORN and its few remaining defenders insist that the "good" ACORN provides outweighs the transgressions exposed in the recent undercover video sting. But, ACORN's massive dumping of these documents and the cavalier manner in which it betrayed the trust of its supporters betrays that talking point. (Unlike ACORN, we have redacted sensitive and personal information.)

ACORN's political agenda is also exposed, with thousands upon thousands of documents revealing the depth of the political machine that is ACORN, and its disturbing ties to not only public employee labor unions but some of the most radical leftist organizations.

The laws governing how sensitive, personal information such as social security numbers, driver's license numbers, immigration records, tax returns, etc. must be treated are very stringent, and thus it seems as if ACORN may have committed serious violations in that department alone, with thousands upon thousands of potential plaintiffs.

The person who retrieved those documents was a local licensed private investigator. He had apparently staked out the office after seeing the videos the two “kids” had taken which started ACORN’s scandal-slide, expecting to see coverup type activities; and boy did he!

Nice! This is akin to taking local copies of websites before they get scrubbed.

I’m glad we have some clever people on our side!

Doesn’t matter. A misdemeanor at most. Also things in a dumpster generally belong to the dumpster owner not the people who threw out the trash...

The dumpsters are probably owned by Waste Management, or some other removal service. I would think that the customer relinquishes ownership of whatever he puts in them, the moment he puts it in there. Just my opinion--not a lawyer.

Dumpsters have already been ruled fair game for the police, I imagine that this holds true for private investigators also. Cops routinely get into dumpsters to gather evidence from people stupid enough to throw incriminating papers away, courts have ruled in their favor. Once it leaves the building, it can be used against them.

As soon as they put them in the dumpster, the intent to destroy the documents had been established. That’s at least obstruction of justice.

You’ve also established exigency. The risk of the dumpsters being picked up by their service is reasonable. Probable cause was already established. I don’t think getting that stuff admitted is going to be a problem as long as you can demonstrate that the documents seized by a citizen came from the dumpster, and were the same documents dumped by ACORN.

What ever happened to Fawn Hall?

According to Wikipedia:

In 1991 she married Danny Sugerman, former manager of The Doors. The two were married until Sugerman's death in 2005. Hall underwent drug rehabilitation for an addiction to crack cocaine in the mid-1990s, it being reported at the time that Sugerman first exposed Hall to the drug.

Exactly. The search was done by private citizens which does not taint the documents. At most the discoverer trespassed and is guilty of a misdemeanor.
