This story has been slipping under the Main Stream Media Radar for some time now.
U.S. Army Major Stefan Frederick Cook Filed a restraining order asking for legitimate confirmation that his Commander in Chief was legitimately in Office, giving him his orders to Deploy to Afghanistan with his unit.
Today in a stunning development, the Military rescinded those orders.
This has set a precedent heretofore unknown. The entire US Military can now not only question it's orders, a requirement of their duty when they believe that an order is given illegitimately, but can expect that their orders will also be rescinded should they question the legitimacy of the CIC who is the ultimate Authority in Command. In other words, Obama.

If Obama's place of birth is going to be examined and it is found that he was born outside the US, then one has to wonder if the last year and a half hasn't been part of a long term plan by the Clintonistas and the DNC. I am speculating that Bill-n-Hil knew of Obama's birth situation, and they set in motion a plan to allow Obama to be elected knowing full well he was incapable of governing effectively. This plan is as follows:
Step 1)Get Obama elected and give him free reign for the first year to muck up any and everything he wishes while simultaneously installing members of the Clinton mchine in key gov. positions
Step 2)Make sure he has a VP with a history of illness (Biden has had a couple of aneurisms)
Step 3)In the middle of his second year, have his VP resign due to illness and replace with Hillary who is strategically in place as Obama's Sec. State
Step 4)Finally allow Obama's real birth information to emerge via a legal challenge that is also allowed to proceed.
Step 5)Once Obama's real history is known, have him graciously resign in the first few months of his third year stating that he was unaware of his true birth info as he always believed what his mother and grandparents had told him
Step 6)Have Hil assume the presidency with less than two years of the term remaining. She will then reverse many of Obama's most egregious mistakes and will be seen by many as a savior after Obama's system wide meltdown. This will let the Clintons run for two more terms giving them almost 5 full terms in power if the plan succeeds

That was 100% my read on this.
Frankly it scares the bejesus out of me.
When the orders do not come from a legitimate source. In other words, I could not order the military to so much as scrub the floors, I don’t have the authority. This says that Obama doesn’t either.
She says on her site that she will be on Lou Dobs today at 11:15, but I don’t know if that was Pacific or Eastern.
I am a bit concerned that the Major will accept a new set of orders, it sends the message that I can pick and choose my orders, O’zero has no more authority to order someone to the Pentagon than to Iraq or anywhere else. It seems to me he has to challenge all orders now.

Technically he can now challenge all orders, just as every other member of the military can and know that the orders are going to get revoked.
Not to mention this little tidbit, I have a Hawaii COLB that was ordered in Feb of 2000 when I got robbed. The State has computer records of the order. It is DATED Mar 6- 2007, when it SHOULD have been dated 2000. This says that the dates can be accidentally changed. Now that isn’t saying that they were deliberately changed, but they CAN be changed. It calls int question the solid viability of the H-COLB’s. Scary no?
Can someone with military court experince translate this?
Does this mean the Major is not in any danger any more?
Did the military avoid the trial by simply changing his orders so this entire legitimacy issue is never going to be investigated?
If they do try and court marshal the major will they rig the trial so that the legitimacy will not be allowed at trial?

What gives me sleepless nights is that US nukes may be under the control of a foreigner who may feel no loyalty to the country which makes Obama unpredictable. It’s most likely that Russian and Chinese leaders have similar thoughts in the back of their minds.
All this can be corrected at once with Obama fully disclosing his identity. Why this continuing secrecy? The man has no sense of honor, whatsoever. And neither have those who support him.

Apparently at DSS insistence Simtech has fired Major Cook from his position. So the guy lost his job because of “nutty and Crazy” circumstances. Simtech is a privately held company.
” The CEO of Simtech, Inc., Larry Grice, explained to Plaintiff over a series of four conversations within the next two hours, that he had been terminated. Grice told the Plaintiff that he would no longer be welcome in his former position at SOCOM but that Grice wanted to see whether he could find something within the company (Simtech, Inc.) for Cook. The upshot was that at this time Grice did not have anything for Plaintiff to do. Grice told Plaintiff, in essence, that the situation had become “nutty and crazy”, and that Plaintiff would no longer be able to work at his old position.
Grice explained that he had been in touch with Defense Security Services (an agency of the Department of Defense[1], with regional offices located in SOCOM Headquarters at McDill Airforce Base in Tampa, Florida), and that DSS had not yet made a determination whether Plaintiff Major Cook’s clearances would be pulled, but Grice made clear to Cook that it was DSS who had compelled Cook’s termination. Essentially, because of the “nutty and crazy” situation and the communications received from DSS was no longer employable by him at all. So he was not optimistic about getting me another job at the company. Grice also reported to Plaintiff that there was some gossip that “people were disappointed in” the Plaintiff because they thought he was manipulating his deployment orders to create a platform for political purposes. Grice then discussed Plaintiff’s expectation of receiving final paychecks (including accrued leave pay) already owed, without any severance pay, and wished the Plaintiff well.”

“With the crisis in place, what do you predict will happen next?”
The military is a tribal society. It’s anybody’s guess what will happen, but I think that there must be some high-level scenario discussions going on privately among O-6 to O-10 ranks.
General: “You know the derelict class in ranks will use this to get out of deployment nearly immediately. If we get a rash of this, all hell will break loose.”
General2: “We have officers in missile silos right now with nothing but time on their hands. If a third of those officers buy into this, they won’t launch under orders. Same with sub captains.”
JAG General: “The cases are going to pile up. As it is we have a Major collecting paychecks and benefits, and we can’t order him to attention right now. We can’t discharge him, and ironically, we can’t even rescind the order. Cook’s counsel is likely trying to figure out how to file a motion telling us we don’t even have the authority to rescind our own orders.”
Head of JCS: “Here’s our options:
1. Do nothing and hope we don’t have a rash of officers and enlisted refusing orders. As of yesterday, we can’t even go to court marshall, because the request for documents to the WH will be the same today as it was yesterday.
2. Have a meeting with the President’s people and figure out what the hell’s going on over there. I don’t hold out much hope there, because again, if they had the docs, we wouldn’t be discussing this.
3. Militarily, the goal is getting ourselves out of the middle of this. We could and should stop giving orders. Practically speaking, what is legally defensible are orders designed to protect men and materiel in the field. What is less legally defensible are orders protecting tactical and strategic military objectives in the field. If insurgents decide to invade Baghdad, can we issue orders to intervene at the Iraqi government’s request? Not a chance, not with our people and equipment out of there. Counterattacks? No way. Missile strikes, no. All of that is legally out.
The irony of this is that it neuters the military completely. If we as JCS decide that the national security is at eminent risk, we can arrest the President, and recognize the authority of the Vice President to become President and CINC. How the VP is going to react is anybody’s guess. It won’t solve the problem of re-establishing legal NCA, because half the officers will back the VP, the other half Obama, and I’m not going to debate the percentages because the result is the same - reasonable cause to question the legality of our orders.
It’s going to look, smell, and feel like a coup. If the country is divided now, it will definitely be after we pull something like that. The reaction of Joe Six-Pack is going to be, “So what if he was born in Kenya?” Are you going to explain what Jefferson and Madison’s thinking was on foreign allegiances to explain why the President’s in a military jail?
4. Right now, our orders have the veneer of legality, even if they don’t have the substance of it. We have to make this a political problem again, instead of a military one.
In my view, only the Democrats can make this go away. Between Biden, Clinton, Pelosi, and Reid, you may be able to make them deal with this behind the scenes, allowing Obama to save face somehow on leaving office. No Republican really has the juice to do something about this because, again, it looks, smells, and feels like a coup, and not a legal problem. What we have as leverage is essentially the law - our ability to refuse to issue any more orders, AND their inability to prosecute us for that refusal. We can’t even legally be relieved of command.
We can tell the four of them that as of last night, we got put out of the business of giving orders the chain of command can legally follow, and the good order and discipline that might prevent a sudden stoppage of following orders is only going to last so long. The benefit of this is that its the truth. We can leave that meeting and essentially go on leave until they decide what they want to do.
One thing they COULD do, the four of them, is agree that there is a legal issue, and that the military is following the law, and their oath, and that the military is agreeing to sit this out. To re-establish our authority, they could ask the President to step aside under the 25th amendment until the legality of the National Command Authority under Obama is Constitutionally verified - inventing whatever story they can all stomach. Biden would be President, Major Cook goes to his base (quietly), and Obama can debate the matter, resolve it, fake his way out of it, but the military gets taken out of the middle.
There may/will be a debate about whether Biden is legitimate under the order of succession due to his election on Obama’s ticket, but it won’t be address that matter until Obama provides documents or admits there aren’t any. Still, the military’s ability to issue orders will, until THAT time, be legally re-established.
If Obama’s not a citizen, Biden will likely carry out the duties of the office until at least 2010, so we’d be OK legally until at least then. It’ll take that long for the mess to be properly untangled.
Regardless, if they invoke the 25th, it would be their mess at that point, not ours. I don’t know, and don’t care whether they’d impeach, pardon, etc. Not questions for my paygrade.
I think this last option is the best for obvious reasons. If this turns any more politically partisan than it already is, then we could have an honest-to-goodness mess on our hands that’ll make the collapse of the USSR look like a historical footnote.”
That’s the best I can predict, but you have variations on the basic theme of temporarily getting the military out of the middle of this as soon as possible.
No matter what, you can’t create a situation that requires ALL military memebers to question the legality of issued orders. What would happen then is that the General Officers would have to make an Imperial Romanesque appeal to the troops in the field that the objective now has become withdrawal and extraction - the safety of men and materiel (survival)- and to start planning for the following:
1. Not getting extraction support from Stateside (they refuse to provide extraction on the grounds of not recognizing the general’s legal authority to order withdrawal, even if the purpose is protecting the troops.)
2. Getting extraction support, and then worrying about whether that support is going to include enough inter-service cooperation to not risk being sunk or blown out of the water/air on the way back home (think having to withdraw through Russian airspace or leaving via the Strait of Hormuz).
3. Getting inter-service support, getting home, and then worrying about what to do once they are all back at home. Do we still have the legal authority to pay our own people, feed them, house them? Don’t know.
4. I suspect what would happen in the event of the Russians or Chinese taking a whack at us in such a withdrawal, will be the Military going on full-auto, and the JCS appointing a Supreme Commander on their own until the matter is resolved. That would force the matter to a head within the administration pretty quickly though, and Biden would likely be VP in a heartbeat.
Best I can do. The trick here is getting the military out of the middle of this as soon as possible.

No one ever suggested that Obama was qualified to be POTUS — it is his eligibility that is being questioned.
Null and void asked me the same question, and I gave a really long reply. I’ll see if I can find it.
To save you the agony of reading through it, it comes down to this:
Reid, Pelosi, Biden, and Clinton have to get the military out of the middle of this. The military needs to make this a political problem again. They have to re-establish the legal authority to issue Cook a legal order, as it were.
To do that, they should recommend that Obama invoke the 25th, making Biden POTUS until Obama can either produce the actual docs, produce suitable fakes, or step down for acceptible face-saving reasons.
Military would be on pretty firm legal ground again. It would still be a political mess, but not a military one.
Any other scenario is very ugly. Only the Democrats can fix this. If either the Military or Republicans try to fix this in any way, shape, or form, then you end up with the situation than any officer can question orders from the NCA.
I’ll link my thinking on this if you are interested, but that’s the gist. The clock is ticking, because individual opportunist members who want out of their deployments will start flooding military dockets to get out of their situations and go home.
Only those who HAVEN’T deployed yet will prevail, however, because once you’ve followed an illegal order to deploy, you can’t follow an illegal order to go home. In that situation, if a member wants to use commercial means of getting out of Afghanistan, I guess that would be possible. That member could literally walk out of their camp, get a commercial flight home, and there’s not a thing anyone could legally do about it.
No one seems to question how world leaders are looking at what is happening right now in our political world. Obama may have become irrelevant to them now that so many Americans are questioning Obama’s legitimacy to be POTUS.
Who wants to sign any agreement with Obama when there is the possibility of it being nullified?
