NEW ORLEANS—Louisiana has 15 days to add the names of both fathers to the birth certificate of a boy born in Shreveport and adopted by a gay couple from out-of-state, a federal judge has ruled.
The state is asking the 5th U.S. Circuit Court of Appeals to overturn the ruling by U.S. District Judge Jay Zainey, and to halt the order in the meantime, state Attorney General Buddy Caldwell said Thursday.
"The federal district court has significantly misinterpreted Louisiana vital records law, forcing Louisiana to import and adopt New York law," he wrote in a brief e-mailed statement.
Oren Adar and Mickey Ray Smith, who now live in San Diego, but adopted the boy in New York state, want both their names on his birth certificate.
State officials say that's illegal because, under Louisiana law, two single people cannot adopt a child. Zainey ruled in December that because the adoption became formal in New York, the Office of Vital Records must recognize that state's adoption law on the matter.

I am sure I am missing something here but... why does LA have to get involved in this at all? The boy was adopted in NYS, why not have them issue a birth certificate?
Or are these guys just trying to make a point by forcing LA and thereby changing the law thru the courts instead of the legislature?
The parents' identities are not always known. Some states (like CA) have laws that allow parents to abandon unwanted newborn babies. The purpose of these laws is to reduce infanticide and child abuse. When an infant is given up in this manner, there usually is no birth certificate or name of either parent. Yet the newborn's birth must be registered, so that he can qualify for public assistance or eventually enroll in school, so the records offices probably use "unknown" or some form of jane/john doe.

I have worked on these issues in counseling. Still, there are times when the old wounds get ripped back open and I lash out, I wish I was better at NOT doing that, but I’ve come a VERY long way in the last TWENTY YEARS since I found out as a rebellious teen...

I’ve still got a LOT of work to do when it comes to forgiveness, you hit that nail right on the head! My personal situation - or so I’ve been told - is every adoption worker and birth mother’s nightmare, so I will readily admit that my experiences probably make me a bit more radical than other adoptees! (My adoptive father worked for the very newly developed DCFS as a CASE WORKER - my BIRTH MOTHER’S case worker, and according to the private adoption agency that was brought in immediately before my adoption was finalized have stated to me that my adoptive father committed fraud in various ways in order to get himself and my mother approved (she was sick and not expected to live past 30 years old according to all of her doctors — she was ALREADY 32 years old when I was adopted). Even as such, I don’t have ANY right to ANY recourse legally - and it’s not like some stupid decree in a court that would only tell me what I already know — that my adoptive father was a child predator, and used the system to his advantage — would help ANYTHING whatsoever! LOL It’s just NOT worth it. And seeing as he has Alzheimer’s now it’s not like he could even be taken to court even if all the statutes of limitation hadn’t expired.
Besides - it doesn’t matter if he is held accountable HERE in an imperfect system. I KNOW he will have to explain himself to GOD, and I trust HIM to know the truth about ALL - and HE can’t be fooled like some are by sociopathic liars (that’s not the right word is it??).
I HAVE accepted (I think) that there is NOTHING I can do to change my situation. Likewise, I recognize that ESPECIALLY now you’re right — it’s a MOOT POINT! I know that - really I do. And as you said, in the grand scheme of things, it ultimately doesn’t matter in comparison to some other things...

A phrase that has served me well: “Everything happens for a reason”. Thanks again for reminding me that my experiences have helped make me who I am (the good parts and the not so good). I honestly WOULDN’T want it to be any different. Even with the pain... I know the LORD has not given me more than I can handle, and everything I have gone through has only made me that much stronger.

I’m very well acquainted with those laws, and it was during the time these laws were first being passed that I was very active in these issues as an activist and media spokesperson for a National Adoptee Rights organization (NOT the one that uses that horrible SLANG term for us adoptees born out of wedlock, although I have worked with some of those people in the past). I and many other people fought tooth and nail against those laws...
I personally do not accept the premise that these so-called “safe haven” laws prevent infanticide and abuse, but please forgive me for not going further on WHY because I just don’t have it in me tonight... Today has been VERY emotional for me... :)
It’s also one of the reasons I DON’T tackle this issue in my activism anymore, and VERY rarely do I EVER speak out on these things anymore... In fact I think this is only the 2nd or 3rd adoption records related thread I have even posted on here at FR since I joined in 2001. There are others better suited than I to speak to these issues.

I’ve always taught part time and counseled in agencies where I didn’t need a license. Never completed that Gate keeping function because I was angry at the unethical structure and Federally illegal charades involved. Sort of bit my nose to spite my face but that was my choice way back then.

BUT -- this 'gay couple' better not stat popping their corks yet (pun intended). The 5th U.S. Circuit Court of Appeals is prolly THE MOST conservative court in America. And I'd bet the rent not one of them has ever read 'Billy Has Two Daddies'. /s
