TMLC: A Victory for Marine LtCol Chessani

ANN ARBOR, MI – Late this morning, the Navy-Marine Corps Court of Criminal Appeals sitting in Washington DC, released their unanimous decision upholding the dismissal of charges against Marine Lt. Col Jeffrey Chessani on the grounds of apparent Unlawful Command Influence. But the case may not be over yet.
For the last four years, LtCol Chessani has been investigated and prosecuted for his involvement in the so called “Haditha Massacre” – a massacre that never happened. A 22-year veteran, Chessani has served three tours of duty in Iraq. He served in the First Persian Gulf War and in Panama. At the time of the November 19, 2005 Haditha incident, he was the Battalion Commander of 3rd Battalion, 1st Marines (“The Thundering Third”) – one of the most decorated units in the history of the Marine Corps.
Richard Thompson, President and Chief Counsel of the Thomas More Law Center, observed, “LtCol Chessani, one of the most effective combat commanders we had in Iraq, was a made political scapegoat by the civilians in the Pentagon to appease the antiwar politicians and a liberal media. In fact, we now know that the story of the ‘massacre’ that prompted the Haditha prosecutions was a headline in a Time news article instigated by insurgent propaganda operatives.”

The Government could also decide to appoint a new convening authority to make an independent decision on whether to re-charge LtCol Chessani essentially starting over.This I fear, since it would probably create the longest delay.

Yes, that would be a disaster for LtCol Chessani. I believe our best hope that doesn’t happen is the cost and the difficulty of finding enough people who haven’t been exposed to the case already should he be recharged.

I sure hope you’re right, but if they didn’t care about the cost, and they havn’t yet, the difficulty factor may be to their liking, since it would be so time consuming.

"Unlawful command influence is 'the mortal enemy of military justice.' [US v Thomas (CMA 1986)]"
"And this court finds, and actually is convinced of one thing beyond a reasonable doubt, that a disinterested member of the public would harbor significant doubts as to the fairness of the proceedings against this accused and the military justice system as a whole if they knew that this accused's main interrogator was, during significant portions of this trial, prepare-not only prepared as a government witness but was seated at the side of the convening authority as a trusted legal adviser while prosecutors and subordinate legal advisers discussed the details of the accused's case and offered legal advise and strategy which could determine whether this accused would be prosecuted and, if so, how."
The opinion is worth reading.

I’m pretty sure that if the Government appeals this decision, then someone should point out to the same said Government that it really should fall them to prove, beyond ANY F****** DOUBT, the Ewers did not, in any WAY, SHAPE, or FORM, NONVERBALLY influence The Mattis (spit) Decison to proceed with a persecution. And I’m talking about THE ENTIRE SPECTRUM of NONVERBALNESS. (somebody get me a subpoena)
In fact, I’ll even give an example, of sorts, of how something nonverbal can speak volumes. One that may have a negative effect on the recipient. A simple hand gesture:
