Is there any reason it shouldn't be a money issue? Why do we have to keep paying to deal with this crap at the last minute, over and over again?
Sec. 15511. Actions by the Attorney General for declaratory and injunctive relief
The Attorney General may bring a civil action against any State or jurisdiction in an appropriate United States District Court for such declaratory and injunctive relief (including a temporary restraining order, a permanent or temporary injunction, or other order) as may be necessary to carry out the uniform and nondiscriminatory election technology and administration requirements under sections 15481, 15482, and 15483 of this title.
(Pub. L. 107-252, title IV, Sec. 401, Oct. 29, 2002, 116 Stat. 1715.)
The U.S. ATTORNEY GENERAL has standing to bring an action to enforce Section 15483, which is the provision of the Help America Vote Act that the Ohio GOP tried to enforce.
So WHERE is the Bush Department of Justice? Asleep at the switch??
Great Catch!
Thanks for the info. I think you’re exactly right.
Looking at the decision again, I think the SCOTUS is making clear that somebody else has to file this.
There will be a refiling soon.
Bush clearly wants McCain and the Republicans to lose this year. I can draw no other conclusion because the silence out of the justice department is deafening on too many critical issues.
Not unless the DOJ decides to get involved. I read the opinion to indicate that NO private litigant would have standing to enforce the Act.
He wants no such thing. It’s just incompetence.
And who do you think has authority over the Attorney General?
Problem is now with this there is a good chance the value of our vote will be at best diluted and at worst invalidated.
A tea party will count, be seen and heard.
If this election goes down with as much fraud as they are reporting it will be the end of talking.
We will need to take our country back.
Only 13% of Americans support income redistribution, 84% do not support it.
We cannot allow a group like Obama/Pelosi/Reid/Dodd/Frank/Murtha/Franken who represent at most 10-13% of our country to hijack and destroy America and exactly what it stands for.
Just curious. If we were invaded, would you bear arms? It’s awful to go about looking to shoot someone, but there have been times that men with consciences and souls found it necessary.
And some of them have been very young. You know, that time of life when everything’s so black/white.
Are you kidding? I bear arms NOW, and have since I was old enough to hold a shotgun. I also have a permit to carry. I refuse to be someone’s victim.
Good plan, providing our votes are worth the paper they are written on.
>>If GOP doesnt have standing, we better find someone who does - and quick.<<
I thought that today is the last day in OH anyone can challenge voter registrations, so even if they refile and win, and Brunner gives the lists to the election boards, it may be too late.
That’s what a TRO is for. There will be one filed today.
I still don’t think it’s too late.
We need to bombard the US AGs office NOW! Hit them with emails like crazy, telling them we want to file an action and get a TRO now.
The Supreme Court has ruled, on an emergency basis, that the trial court and therefore the Circuit Court had no power to rule that the Ohio Secretary of State was violating the law. They did so because they said that "private parties," such as the Ohio GOP, had no right to come to court to enforce the law.
What the SC did NOT do is agree with the SecofSt of Ohio that she was right to allow massive vote fraud to occur right under her nose, and do nothing about it. As I read the Opinion, the Attorney General of the US could, and should, act immediately to seek the same relief that the Ohio GOP did in the original filing.
I ask that you, or others, who are participating in the threads on this issue would repost this comment of mine into other threads. Since I am one of the Freepers who has sought, and obtained, emergency relief in the Supreme Court. So, what I've said here might be useful to others.
I am leaving shortly to travel to a funeral out of state, so I will not be available to participate in the discussions. I hope these comments are useful here and on the other threads.
Cordially,
Congressman Billybob

That’s what I keep on saying!
We need to bombard the AG’s office with emails NOW!!!
Is anybody listening?
