Judge suspends Nifong, proceeds with request to remove him

DURHAM, N.C. (AP) -- A judge suspended District Attorney Mike Nifong today after learning the prosecutor disbarred for his handling of the Duke lacrosse rape case intended to stay in office for another month.

Superior Court Judge Orlando Hudson wrote in his order that Nifong's actions has brought his office into disrepute.

State lawmakers are scheduled to take up a bill later today that would allow Governor Easley to immediately remove Nifong from office.

Nifong said in a letter released yesterday that he would leave office on July 13th.

His legal assistant, Candy Clark, says Nifong wasn't in the office today. The one case he was currently handling was being reassigned.

Sheriff Worth Hill says he went to Nifong's house and took the keys and badge that gave him access to his office.

I understand from other articles that he will still be paid...until he is removed... He'll need the money though... Wonder how much he owes his attorney and if Durham is paying for his legal counsel?

Good. Nifong needs to be persecuted the same way he went after those innocent boys.

I heard he needs to stay in office through July to get 100% vested in his pension.

Nifong has started writing his memoirs of the Duke case. He will become a wealthy man, more so than if he had kept his job.

If that is so, about his pension, I mean, can it be attached as a means to pay damages for the inevitable lawsuits that will come along?

Also, on FOX & Friends this AM, they said that he would be getting his pension which is about $5,000 per month. That obscene!

I thought there was some sort of law that you could not profit from a crime by writing a book.

I've read a couple of articles on this today, but I haven't seen by what authority this judge removed hime (not that I'm sorry to see him go). The above sentence makes it even more confusing as it seems the legislature is saying that there is no current law by which then can force him to leave.

A) That varies by state, and

B) Nifong hasn't been charged with a crime.

A crime is an offense that’s either statutory or prohibited under common law and recognized. Nifong’s conduct, as reprehensible as it was, is not a crime. He can be sued if he doesn’t have prosecutorial immunity, which I think he probably does but there is no crime in the facts I’ve seen and I’ve followed this closely from a professional interest. Whether one can profit from a ‘’crime’’ is not even in the picture here nor is it on the horizon.
