I do not think that it includes judges forbidding active debate about observable things What is obesrvable about the process of Creation? By definition it is unobservable (unless something has *poofed* into existence in a recorded way that you know of).
We have evidence, we have theories that attempt to explain that evidence. Creation is not a theory. It is a belief.
