Does this mean that DeLay refused to invoke his immunity during session?

Delay has no immunity from a collection of charges that include a felony. His first filing however, seeks to have the Money Laundring count dismissed as the activities cited in the other charges under campaign laws of Texas are the same acts and the campaign laws should govern.

But, until them, the Democrat Prosecutor got his "felony" charge from the GJ as part of the indictment.
