Waters were receding across this flood-beaten city today as police officers began confiscating weapons, including legally registered firearms, from civilians in preparation for a mass forced evacuation of the residents still living here.
No civilians in New Orleans will be allowed to carry pistols, shotguns, or other firearms, said P. Edwin Compass, the superintendent of police. "Only law enforcement are allowed to have weapons," he said.
But that order apparently does not apply to the hundreds of security guards whom businesses and some wealthy individuals have hired to protect their property. The guards, who are civilians working for private security firms like Blackwater, are openly carrying M-16's and other assault rifles. Mr. Compass said he was aware of the private guards, but that the police had no plans to make them give up their weapons.
Nearly two weeks after the floods began, New Orleans has turned into an armed camp, patrolled by thousands of local, state, and federal law enforcement officers, as well as National Guard troops and active-duty soldiers. While armed looters roamed unchecked last week, the city is now calm. No arrests were made on Wednesday night or this morning, and police received only 10 calls for service, a police spokesman said.
The city's slow recovery is continuing on other fronts as well, local officials said at a press conference late this morning. Pumping stations are now operating across much of the city, and many taps and fire hydrants have water pressure. Also, tests have shown no evidence of cholera or other dangerous diseases in flooded areas, though health officials have said the waters contain levels of E. coli bacteria and lead 10 times higher than what is considered safe.
Efforts to recover corpses have also started, although only a handful of bodies have been recovered so far.

If the second ammendment were in force, there would be no cause for such regulations to exist. Do you really believe that the government is here to pull everyone's fat out of the fire? It's your job to protect your family, and it is the government's job to keep the nation strong, thus protecting your rights, and your ability to provide for your family.
I'd like to think so too, but the fact that the BATF (as seen in pictures) is doing the house-to-house sure makes it look very suspicious to me.
IMHO, these code sections must be rescinded.

Why would you want to rescind the ability of the President to protect people from deprivations: " -- of a right, privilege, immunity, or protection named in the Constitution and secured by law --- " ?
Doesn't he have a sworn duty to do so?

Perhaps you didn't read the code sections that CO posted carefully enough. Those sections allow the Gov. of La. to demand that the president crush the rebellion that she is fomenting. Understand? The meaning is opposite of what you were assuming.
That actually doesn't mean much anymore until there is some "on point" binding precedent to come out of the US Supreme Court. I take it you're referring to either the 2nd or 4th Amendments. The 2nd has no cases right ON POINT that are less than 100 years old except for Miller v US and that would seem to be a victory for us, but is never treated as such. Louisiana can always assert 10th Amendment States Rights to tie things up.
My father in law never worried about gun control laws always seeking to assuage my fear by asserting: It's alright son....they can't do THAT it because violates the 2nd Amendment! Well, okay so how did Morton Grove, IL and the State of California and Washington DC and Massachusetts and other places manage to effect total gun bans and have them upheld for decades? There is NO Declaration of Martial Law in NO. That was made crystal clear today. How can they confiscate lawfully held firearms at a LOCAL level? I'm betting that the action violates both State and Federal Law. Yet it's being done.

There are no court in New Orleans. Most of the criminal and civil cases will be wiped clean, because evidence is destroyed, witnesses are gone, etc.
Even indicted Aaron Broussard will probably get a free pass.
I knew that, but so? Even if the second amendment did not apply to the state, the Louisiana constitution provides:
"The right of each citizen to keep and bear arms shall not be abridged, but this provision shall not prevent the passage of laws to prohibit the carrying of weapons concealed on the person." Article 1, Section 11.
The NOPD Chief suspended those laws. Mayor Nagin is in Dallas today.
The state of Louisiana does not register guns. The only "registry" would be those *federal* forms that all those who purchase from a *federally* licensed dealer must fill out. For those they'd have to "raid" the gun shops, pawn shops, sporting goods stores, some hardware stores, and of course WalMart, since that's where the forms are kept.
And if you really believe they will, they must grow better stuff up in those hills than I thought. These people will never see their weapons again. BTW, there are no such permits to own in Louisiana, any more than in Texas. Permits to carry concealed handguns are issued. Not sure about the legality of open carry. No permit required to carry a long gun. That's all from the NRA-ILA summary of LA gun laws.

They did. But if it was like most such laws in southern states, until somewhat recently, and in some locations not even now, was the law enforced against the white population. Now they've modified the law to prohibit concealed carry, *unless* you have a state issued license to do so. It's a "shall issue" type system.
Some? The thing is so full of holes it might as well be Swiss cheese. And that's just on matters of fact, not of legal opinion. Mark Levin's book is much better, or at least more factually correct.
I saw that too, but what I didn't see, because I wasn't paying enough attention, but was told about by FReeper jdrive who did see the whole incident, was that the old lady had a revolver, which she was peaceably showing to the officers as part of her argument that she should be allowed to stay in her home. Some of these guys are like pit bulls, but instead of being trained to salivate at the sound a bell, they are trained, or conditioned I would say, to attack at the sight of a firearm in civilian hands.
I hope the old woman sues him and his department/agency for enough to pay her nursing home bills for the rest of her life, assuming the old bird ever gets feeble enough to need to be in a such a home, she certainly doesn't now.
I didn't know my great granny. (Well I met one of them once, but she was already far gone into dementia). However my maternal Grandmother didn't hesitate an instant before cutting the heads off of snakes with her hoe. That give you any hints?
