That's the part I don't get either.
Scalia has been our friend in the court for a long time....
..Do you suppose Scalia doesn't want the position?....nah, that wouldn't be it.
So I don't know how Roberts can go to the head of the line.
Nothing against Roberts...but I really like Scalia.

Bush is going to take the heat for not promoting from within. There was a chart I saw yestrday, that showed that 11 of 16 Chief Justices were picked from outside the existing Justices.
Surprised me, that's why I remembered it.

The CJ is very rarely chosen from within. I believe that Rehnquist was only the fourth.
There will be no 'heat' for not promoting from within.

spectre, unfortunately, Bush gets heat for what he eats for breakfast, how he ties his tie, what brand of shaving cream he uses, what color shoes he wears on a certain day, how he combs his hair......I could go on, but you get the point.
