Developer Begins Process to Seize Justice Souter's Homestead

Last week, I reported on the Supreme Court's Kelo vs City of New London decision, which seriously weakened Constitutionally guaranteed private property rights.

Now, in what can only be viewed as an attempt at pure poetic justice, a budding developer, businessman Logan Darrow Clements, has begun the process of seizing Supreme Court Justice David Souter's homestead in Weare, New Hampshire and replacing it with a hotel.

Citing the Kelo decision, Clements has contacted Weare's building official, saying:

"Although this property is owned by an individual, David H. Souter, a recent Supreme Court decision, "Kelo vs. City of New London" clears the way for this land to be taken by the Government of Weare through eminent domain and given to my LLC for the purposes of building a hotel. The justification for such an eminent domain action is that our hotel will better serve the public interest as it will bring in economic development and higher tax revenue to Weare."

Think the Fab Five ever considered that the Kelo ruling might directly threaten their property rights?

As I've said before, when our Constitution is ignored, all Americans suffer the consequences.

Clements is currently seeking investors to fund the project. He can be reached by clicking here. Encourage him to develop similar plans for properties owned by Supreme Court Justices Breyer, Ginsburg, Kennedy and Stevens.

I emailed Mr. Clements with the suggestion that he allow small investors to buy into his hotel. I told him that if he would include one free night's stay as part of the purchase of a share in his hotel he would raise MILLIONS of dollars!

I think because of Souter's vote on "eminent domain", he's in imminent deep do-do. Just hope Ginsburg, Stevens, and Breier aren't far "behind".

What's he gonna pay Souter for his digs? Not more than a pitance, I hope.

Souter enjoys very low property value assessment of about $100,000 and pays property taxes around 2600/year, according to another FR article.

So, they aren't getting a lot of tax money out of him. A hotel would CERTAINLY bring a lot of tax benefit to the municipality/county.

and pull out all the stops when the crazoids on the Court decide to screw the elderly, the handicapped and the poor

When he made his ruling I am sure he never thought that this could come back and slap him in the face.  This is one of the best examples of someone who will either back down and change his ruling or fight against his own decision.  It's beautiful!!

4th Amendment conflicting with the second amendment, I'm not to sad the 4th yielded to the 2nd..especially when no injury is done to the land owner in this case.

Only problem I can see is with Ginsburg. Something spooky about that old bat. Bet she lives in a cave or someplace dark. Hey, anybody ever see her out in the daylight?

Believe it or not she is one of Justice Scalia's best friends.

Actually, and I could be wrong, someone feel free to correct me if so, but I believe we actually had 2 0r 3 Repub senators with enough ba@@s to vote no on her confirmation.

Yup, you are correct. The vote was 96-3. Only 3, THREE Republicans voted against and now look what that has led to.

Might it not be more effective to go after the families and friends of these traitors.
That way they would be on the receiving end of complaints that never end. They would be forced to reconsider their position.

Can you imagine the atmosphere at home after a law YOU are responsible for rises up to bite one of Momma's little darlings?

I say, go after the property of the five justices that oppose private property rights. What muawiyah was saying (post 19) was that we should even go after the Justices that were in the minority (the 4 judges who dissented in favor of property rights). If we did that, the USSC would not be able to rule in the case (since all 9 would have to recuse themselves) and we would still be stuck with the Kelo decision as a USSC precedent. I would rather have the 4 justices that dissented be able to decide the case (and based on the Kelo breakdown, we would have a 4-0 ruling that would toss out the Kelo precedent).

Although, it would be amusing to have one of the 4 make a tongue-in-cheek dissent to poke fun at the 5 that would be recused.

Weare, New Hampshire (PRWEB) Could a hotel be built on the land owned by Supreme Court Justice David H. Souter? A new ruling by the Supreme Court which was supported by Justice Souter himself itself might allow it. A private developer is seeking to use this very law to build a hotel on Souter's land.

Justice Souter's vote in the "Kelo vs. City of New London" decision allows city governments to take land from one private owner and give it to another if the government will generate greater tax revenue or other economic benefits when the land is developed by the new owner.

On Monday June 27, Logan Darrow Clements, faxed a request to Chip Meany the code enforcement officer of the Towne of Weare, New Hampshire seeking to start the application process to build a hotel on 34 Cilley Hill Road. This is the present location of Mr. Souter's home.

Clements, CEO of Freestar Media, LLC, points out that the City of Weare will certainly gain greater tax revenue and economic benefits with a hotel on 34 Cilley Hill Road than allowing Mr. Souter to own the land.

The proposed development, called "The Lost Liberty Hotel" will feature the "Just Desserts Café" and include a museum, open to the public, featuring a permanent exhibit on the loss of freedom in America. Instead of a Gideon's Bible each guest will receive a free copy of Ayn Rand's novel "Atlas Shrugged."

Clements indicated that the hotel must be built on this particular piece of land because it is a unique site being the home of someone largely responsible for destroying property rights for all Americans.

"This is not a prank" said Clements, "The Towne of Weare has five people on the Board of Selectmen. If three of them vote to use the power of eminent domain to take this land from Mr. Souter we can begin our hotel development."

Clements' plan is to raise investment capital from wealthy pro-liberty investors and draw up architectural plans. These plans would then be used to raise investment capital for the project. Clements hopes that regular customers of the hotel might include supporters of the Institute For Justice and participants in the Free State Project among others.
