Someone posted a Supreme Court case in Missouri that was very similar to the Shiavo case, where the court sided with life. Scalia agreed with the ruling, but added that he didn't think that the court was qualified to make these decisions and that the states should pass laws covering the issue. (or something to that effect)
They won't touch it because there is no constitutional issue for them to consider. The paradox is to complain about judicial tyranny while, at the same time, scream because the courts refuse to intercede where there is no basis to do so.
