Just on Fox: Judge going back to chambers to review plaintiff (parents) request for restraining order and tube reinserted.

Is the legislation in Congress for the purpose of letting the courts decide the Schiavo issue instead of letting the husband decide?

It was NEVER the husband's decision. It is supposed to be Terri's. But seven years after Terri's "collapse", and very shortly after the husband was engaged to his current "fiancée", the husband and two of his relatives told of different occasions when Terri supposedly said she wouldn't want to live in her present state. There is no evidence of any of them knowing of such a wish prior to that time. Further, at the time the statement was made, there was no way it could have resulted in starvation and dehydration, and there is no basis for believing Terri intended it to be interpreted that way.

Nonetheless, Judge Greer decreed that that hearsay constituted "clear and compelling evidence" that Terri Schiavo would rather be fatally dehydrated than allowed to live at home with parents who want to care for her.

The reality is that this case will be in the Circuit Court in Atlanta by tomorrow. If this judge had any inclination to side with the Schindlers he would have issued an emergency stay while he reviewed the facts of the case.

I'd like to think that if our President can be signing legislation after 1:00 in the morning, this judge could be drafting his decision, but my best guess is that we don't hear anything until the morning.

Maybe the president can do something about it if we all call him or write to him.

The president can write an executive order to get Terri into a hospital immediately. It is not breaking any law to do so. The judge can still take time to ruminate over this case. This action would not interfere with the judge. And since Greer already flaunted a Congressional subpoena his ruling is highly questionable.

Executive orders are lawful. They've been written by presidents ever since Washington on a number of different issues.

Contacting the president and ask him to write an executive order immediately. If you cannot reach him, then contact your state senators and representatives.

Felos and Hospice certainly. Not so much the husband. He's just a two-bit crook. Terri's hist first intended victim, and he's so inept he can't even give a softball interview without slipping up. But Felos, Greer, and Hospice have things set up sufficiently smoothly it's obvious they've done this before. It wouldn't make any sense for them to go through all the trouble of setting up a death mill for just one person.

I certainly agree that Felos and Greer seem more than a little experienced in this sort of thing. I've seen it posted that Michael Schiavo was on the Board of Directors of the Hospice. I haven't seen it verified. But if so, it explains why she was sent there and why he has had so much influence there.

The most disturbing aspect of this case is the fact that the estranged husband waited all those years before he was enlightened as to what Terri's wishes supposedly were. When he was asked on Larry King tonight why he waited so long he replied that he was holding out hope that something could be done for her. How would this be possible if he was refusing authorization for any kind of recuperative therapy?

No, you are correct. It IS a male judge. Just got the wrong informatioon from the guy that was on hannity this afternoon. The Judge IS a male and...I hope and pray he makes a decision soon and the right one at that.

I'm afraid that the family's legal representatives did not have investigators to go hunt down witnesses for Terri such as these friends on Greta tonight. They have not had the best.

If someone is in the late stages of death from terminal cancer or various other diseases, their body will be unable to use any nutrition which the digestive system puts into the bloodstream. Feeding such a person will neither prolong their life nor make it better.

Terri is not terminal (at least I hope she isn't yet). Unlike a late-stage terminal cancer patient, she will starve if she is not given food, and she will dehydrate if not given water. For her, starvation and dehydration are paintful, and may be alleviated by giving food and water.

Put simply: Terri isn't being starved/dehydrated because she's dying, but because she's not dying.

It was Randall Terry today on Sean's radio show. I do wish the family had had spokespersons without their own agendae. These people don't garner much respect from many.

What about the kids with Cerebral Palsy? My cousin had it and was in the exact shape Terri is. I wonder how long it will be before some judge rules that those kids would not want to live that way...so stop the baby food they have to eat and stop the water.

Slippery slopes are becoming dangerous cliffs.

That's not good. If I were in bad shape and unable to communicate, I would rather have my wife decide than for some government official to decide. ...don't even think I should have to notify some public official in writing (by will or whatever) in advance, either.

And BTW, isn't hearsay allowed in civil cases?
