Someone please explain to me: if the legislation passes and the Schindlers are permitted to bring the case before a federal judge, what is to prevent the judge from making the same kind of idiotic determination that Judge Greer made? This is no guarantee that Terri will be saved--is it? Am I missing something or am I right that the celebrating is premature?

No you are right but it is a victory in a larger war and we should celebrate it as such.

Technically, you're right.

Yes, the federal side opens many baskets. But, first is to get it OUT of the murderer's court - he is so power-mad/power/revenge-crazed by the family that Greer is unable todecide anything right now.

But, consider that every death sentence case DOES end up in review at the Supreme Court.

I would HOPE that RICO and Civil Rights suits vs. Greer and Michael S would be forthcoming. If so, the DISCOVERY phase would be extremely interesting!

This is literally a death match between the Judicial Oligarchy and the other two former branches of government.

Neither side can afford to lose.

A federal review would be de novo. It would begin the case anew and all the issues would be relitigated. There would years of appeals before Terri's food and water could be withdrawn. It would buy her the most important thing of all: time. She could wake up or she could die on her own before its all over. Life's unpredictable and that's what makes it worth living.
