On March 26, 2004 a contempt of court hearing is slated for Michael Schiavo. The previous hearing was postponed until now for at the request of Michael's attorneys.

SHE'S IN DANGER AS LONG AS MICHAEL CONTROLS EVERYTHING ABOUT HER, IN AND AROUND HER. She's a prisoner -treated worse than POW's or terrorists we are holding.

You're right but what can we do about it? The most frustrating and infuriating aspect of this is that we are helpless except for writing emails and letters (which I have done). Oh, and sending donations to www.terrisfight.org which I have also done. Thank Goodness for the freepers who are near enough to actually pound the pavement.

ACLJ Continues Fight to Appeal Florida Court Denying Intervention for Parents of Terri Schinlder Schiavo

Clearwater, Fla., April 5, 2004—The American Center for Law and Justice, specializing in constitutional law, today filed a Notice of Appeal stating that it will appeal to the Second District Court of Appeal a March 11th decision denying a motion to intervene on behalf of Robert and Mary Schindler—the parents of Terri Schindler Schiavo - to permit the parents to become directly involved in defending "Terri's Law"—legislation that cleared the way for Florida Governor Jeb Bush to restore life-saving measures to Terri Schindler Schiavo.

"We will once again appeal a legally flawed decision that excludes the parents of Terri Schindler Schiavo from direct involvement in defending a law that is keeping their daughter alive,” said Jay Sekulow, Chief Counsel of the ACLJ, which represents the Schindlers in the state case. “The appeals court has overturned the circuit court judge on this very issue before and we are hopeful that the appeals court will reach that conclusion once again. Terri’s parents have sound legal reasons for intervening directly in this case and we are now preparing briefs to be filed with the appeals court on this critical issue.”

On March 4th, the ACLJ filed a renewed motion in Florida court on behalf of the Schindlers asking the court to abide by the February 13th findings of the 2nd District Court of Appeal, which concluded Pinellas Circuit Court Judge W. Douglas Baird did not follow judicial rules when he denied an ACLJ motion to intervene on behalf of the Schindlers in November 2003. The appeals court ruled that Judge Baird’s order be reversed and sent the case back to him “for further proceedings.” On March 11—seven days after the renewed motion was filed—Judge Baird once again denied the motion to intervene.

The ACLJ contends that the Schindlers must be permitted to intervene in the case – to take a direct and active role in defending “Terri’s Law”— a law that is at the center of keeping their daughter alive. Terri's husband, Michael Schiavo, wants Terri's feeding and hydration tubes removed. He filed suit challenging the constitutionality of "Terri's Law" and has the support of the ACLU.

The ACLJ is representing the Schindlers in Schiavo v. Bush—the legal challenge to the constitutionality of the actions of the Governor and state legislature. Patricia Fields Anderson, an attorney in St. Petersburg, serves as ACLJ local counsel in Schiavo v. Bush and represents Terri's parents in all other aspects of the Schiavo case.

People at the courthouse don't care and we're trying not to upset Terri's apple cart while helping her. We'll take care of Judge Greer in November at the ballot box but he could do a lot of damage before then. BOMBARDING THE BUREAUCRATS AND THE MEDIA IS OUR BEST TOOL to help Terri. It sounds repetitive but even just once a week calls to Tallahassee and emails to national media outlets is helpful. Telling friends and family to DO SOMETHING is helpful.

You know, something came to me today while I was brushing my teeth. I nearly gagged for some reason, but it made me think about Terri's two missing teeth. Where did they go? My amazing idea was "What if she swallowed them?" If Michael or the doctors hypothesized this, then what would be the obvious implication...that Terri is able to swallow. If that were true, then they'd have to try to cover it up, because they say she cannot.

On the other hand, if her body was attempting to swallow one or more teeth after being dislodged, could that also have not caused her to begin regurgitating? I don't know the answers, these are mere speculations...but weird things do have a way of happening. I wish there was some way to determine where those teeth are and how they came out of her mouth.

Enough for now. Back to shooting off e-mails for Terri!

HEARING NOTICE

There will be a hearing in the matter of Schiavo v. Bush, this Friday - April 16, 2004 at 3.00pm at the main Courthouse in Clearwater, Florida.

Judge Baird is revisiting the matter of the protective order (denying Governor Bush of discovery and the ability to take depositions) as ordered by the 2nd District Court of Appeals.

This is a public matter and you are welcome to observe.

The Clearwater Courthouse is on the corner of Fort Harrison Avenue and Court Street in Clearwater, Florida.

Not to be argumentative, but according to the Pinellas County Civil/Small Claims Docket (http://pubtitlet.co.pinellas.fl.us/index.html), the original notice for hearing for 041604 at 3:00 pm was replaced by an amended notice of hearing, setting it for 041904 at 3:00 pm. I'm sure you would know best when it is, but perhaps it wouldn't hurt to double check it?

Please Report: Suspected Lack of Care for Terri Schiavo

Missing Teeth/no treatment - rotting stump - serious possibility of untreated infections - this could be criminal neglect on the part of Michael Schiavo and Park Place because it has been brought to their attention and the concern isthat nothing is being done.

Poor daily hygiene - One employee of the facility, when asked by Mary (Terri's mother) why Terri had not been bathed, said that the hospice would not supply the toiletries necessary, and asked Mary for money to get shampoo, etc. for Terri. Mary gave the employee $20.00, but the money was returned the following day by a manager, who informed Mary they couldn't accept it. However, Terri is still not being kept clean. - this could be criminal neglect on the part of Michael Schiavo and Park Place because it has been brought to their attention and the concern is that nothing is being done.

Terri is not receiving any social activity Social Isolation (cruel and unusual punishment by cooking up accusations against her parents and then denying her
visitation by her parents and siblings, etc., priest, etc.)/not allowed to go outside in the fresh air.

No Physical, Occupational, Speech Therapy

You do not have to be an actual witness to what is being reported. All you have to do is say you have heard that there is abuse. Report that you have concerns about a patient located at Park Place at the address above with the items mentioned ie, bed sore, lack of care, missing teeth (possible infection to not being treated as at least one is not completely missing as well, etc.) Terri's
parents are being denied medical information even after the fact of a February 24th letter to Park Place authorizing release of medical information to Terri's
parents because there is a 1996 court order requiring it. Michael tried to avoid a contempt of court charge at the last minute by this February 24th, 04 letter to Park Place. If you do give your name you are guaranteed under law to receive a phone call and a written communication from a field officer once they are able to investigate further these going ons. Terri is being subjected to criminal neglect by both Michael Schiavo and Park Place. She is not receiving rehabilitation guaranteed to her under Florida law for the disabled which is a retained right. She is being warehoused and they are letting her health deteriorate. Do not take no for an answer that this is not a crime. Take these actions. Terri is being denied visitation of her parents, siblings, and priest.

What an Easter gift Michael is giving Terri with the help of Park Place. The aide who supposedly found Terri in a certain condition either has something to hide or there was someone who came in the room after Terri's parents left because she was in her street clothes and Felos quotes in an accusing press release trying to implicate Terri's parents that a needle cap was found in her gown, etc. she was in her regular clothes and didn't have a gown on according to Terri's parents. For some reason if you report about the denial of visitation you will be told that they can't do anything about that (because they say Michael is her next of kin) but you can report about the other items of her being subjected to criminal neglect, that she is being denied range of motion therapy and other therapies to make her well, that she is being warehoused, that workers at Park Place may have malice towards her or are being criminally negligent, that she may have an infection in her mouth (where she has a missing tooth and another practically missing tooth) because she is not being treated and that this would be part of Michael's plot for Terri to die by infection and if this is happening Park Place is complicit in the crime by letting it continue.

Thanks for listening and for taking action. The Health Administration uses Jeb Bush's name on their letterhead, they better stop and consider seriously not being complicit in this plot to have Terri killed and not fob off these complaints as unfounded. 1993-2000 depos of Michael and his CNN transcript with Larry King available to show that he is trying to kill Terri from the very beginning and is still planning and conniving in his attempt on her life to have this done under Florida State law when it is he himself that should already be behind bars.

You know I'm sorry but I CANNOT GET OVER the fact that there has NOT been an MAJOR Intervention on behalf of the State of Florida. This is so plainly a case of OUTRIGHT MURDER and it is continuing to be entertained week after week after week after month.!! The BRAZEN and OPEN JUDICIAL CORRUPTION is astounding!! My mind almost can't compute that this is going on right in an IN YOUR FACE" fashion. I'M SPEECHLESS!! The USA is a land of freedom is it not? In my opinion, this has become a delibeerate game of delaying tactics with the hope that Terri will just die. There is NO AUTHORITIES in Florida as far as I can see!
