[history]
December 24, 2003 -- Rush Limbaugh tore into Florida prosecutors on his radio show yesterday - suggesting they're part of an evil Democratic plot to defeat him "in the court of public opinion." The top-rated conservative talker, furious a judge is letting prosecutors examine his medical records for evidence of "doctor shopping," accused them of smearing his name through unsubstantiated leaks to the media.

Don't have to...it's self-evident assuming you understand "rights" are things that have to be observed in spite of investigations.

The first kind of shopping (an "excessive amount") is not culpable to the patient. Only the second kind (overlapping prescriptions) is. As for how "difficult" it is, pharmacies already have to keep unbelievable amounts of computer records to meet Federal strictures on specially controlled drugs.

If Roy Black is such a smart lawyer, how come he hasn't told his client to keep his damn mouth shut?

I'd half believe it even in their cases. Florida's executive and courts (with very few exceptions e.g. Jeb) have richly proven themselves more than looney, more than stark raving mad.

I think its something many celebrities develop. They are surrounded by people saying Yes Sir! to everything they say, causing them to sometimes lose normal social constraints. The public places them on a pedestal, and eventually the pedestal becomes a comfortable place to be. They feel they are above the common herd.

Correction: executive and courts, and except for some brief fits of sanity, legislature.

According to Mark Levin on Hannity yesterday....
Levin named two Dr's. who had their records seized.
The DA alledges RUSH went back and forth to the 2 Dr's...
Mark reveals, BOTH Dr's work at the SAME FACILITY...one was subbing for the other and issued prescriptions while the other guy was on vacation.
The third Dr. was his EAR DOCTOR!!!
I find it difficult to believe that the DA has to get RUSH's medical records in order to prove that he Dr. Shopped. It's much like providing incriminating evidence against yourself...you don't have to do it. The DA must prove the case on it's own, without having the medical records.
Mark is assisting RUSH in this legal issue.

"Why haven't the witch hunters subpoenaed all Florida pharmacies for things under Rush's name?"See any doctor on a cash basis and give him any name you want. He's not going to ask to see ID. And when you get his Rx filled, the pharmacist isn't going to ask you for ID either.

The difference is his lawyer is right, and you are wrongWe are talking about the same lawyer, right????
Roy Black, the guy who defended William Kennedy Smith and got him off the hook.
Not to mention the guy defended the kid who killed his teacher and then argued he shouldn't receive a life sentence.

Vice versa is never "said." It is "interpreted."
To: GRRRRR
Maybe they will get him on a technicality, if these two sub doctors wrote him prescriptions with so much as a day of overlap. After all they were "two different practitioners"! No matter they represented the same doctor's office working off the same records on the same case.

Don't have to...it's self-evident assuming you understand "rights" are things that have to be observed in spite of investigationsI'll take that as a "no, I just like the sound the keyboard makes".
By your definition of "rights" they're going to have to let a lot of people out of jail who are in on drug charges.

As for how "difficult" it is, pharmacies already have to keep unbelievable amounts of computer records to meet Federal strictures on specially controlled drugs.
Once again, this would require several thousand subpoenas. Some chain pharmacies linked by computer might be handled by one subpoena but the numbers would still be enormous.
If this werent Rush, but just some construction worker or cab driver, would people be so quick and rabid in their defense? What makes Rush so special? Are celebrities to be held to a much lower standard than the commoner?

"...right to privacy..."So you don't think doctor-patient confidentiality is a legal right? Doctors have been disciplined and even successfully sued in court for violating that. How about lawyer-client confidentiality? Confidentiality of the confessional?

If Roy Black is such a smart lawyer, how come he hasn't told his client to keep his damn mouth shut...I have wondered that myself!

Roy Black, the guy who defended William Kennedy Smith and got him off the hook. Not to mention the guy defended the kid who killed his teacher and then argued he shouldn't receive a life sentence. So now you're judging Rush on the record of his lawyer? Black's point has nothing to do with any other case.

By your definition of "rights" they're going to have to let a lot of people out of jail who are in on drug charges. Police officer: "Excuse me sir, I pulled you over because you neglected to use you turn signal when you changed lanes. You may be high. I will have to search your car for drugs."

When they came for Linda Tripp, I didn't speak up, because I wasn't a "felonious wiretapper". When they came for Jim Robinson. I didn't speak up, because I wasn't a "copyright-infringing thief". When they came for Rush Limbaugh, I didn't speak up, because I wasn't an "illegal dopehead money-launderer".
