Going for the records indicates that they want to pursue whether Bush lied to his doctors to acquire the drugs. I bet federal or state law applies in a way that such misrepresentation can be illegal.

Further, the doc's might be potential targets as well.

My issue here is that they are going after Rush for making LEGAL withdrawals from his bank account to buy the pain medicine..if they cannot prove that he was doing something wrong to begin with the medical records have no basis in law to be taken

Someone please help me here. My stepdad insists that no doctor would prescribe enough drugs that someone could get addicted to them. So, he's sure that Rush got them illegally. I have no clue about matters such as this, so I told him I'm just waiting to find out the truth and I'm in no rush to do so.

If Rush wasn't part of a drug ring (per his statement), does that mean he was getting drugs illegally?

I want to believe the best here.

Thanks!

Candi

"You are our legal expert can they seize a patients files from a doctor?"

With sufficient probable cause and no strong objections from Rush. I doubt he would object as releasing the files to the CA will only tend to prove his position. On the other hand, should they leak the files, he will own southern Florida.

It was this constitutional provision that permitted the Fla. Supreme Court to throw out parental notification rules enacted into law for minors seeking abortions (like the Fl. Supremes needed an excuse).

That has absolutely nothing to do with the fact that if he legitimately needed the drugs as he claims, his doctors would have given him prescriptions for them.

I meant to say wasn't getting drugs illegally.

That makes sense to me. If Rush was addicted to "prescription" drugs, I am sure the police wanted to know how much was being prescribed and by whom. It is not unheard of for a doc to be implicated in a precscription writing(for a fee) scam.

Four Doctors? Oh, I get it. He was going to four doctors so he could get four perscriptions at a time. That's bad enough, but are we supposed to believe he was also getting them from his housekeeper? Man, that's a lot of drugs.

It seems that his own doctors would have given him the prescriptions if he needed them.

the way it works is that a Dr issues a legitimate prescription for the drug, the patient uses them and often (in cases where the pain is chronic and the usage open ended)gets hooked on them. Sooner or later the Dr or the pharmacy gets antsy about issuing or filling the scripts and the patient changes Dr's and pharmacies...eventually they buy them on the street.

I have a brother in law who's been through this and I usually have zero sympathy for druggies...but he got hooked on oxycontin by legitimate use. It's not like he drove to the ghetto to buy crack and eventually got hooked.

President Bush is involved in this, too! I knew it! :)

private medical records are not public records.

"Perhaps the doctors are the actual target of the investigation."

My thoughts, exactly. Here in Northern Virginia, the Fairfax County Attorney has announced a crackdown against so-called "pain doctors". A couple of docs have already had their offices raided, and files confiscated.

I agree with you. The dems are looking for payback. Plain and simple. Asner is probably involved somehow....
