Normally I'd say this is farfetched. But the fact that Tommy Franks believes this to be true is disconcerting, to say the least. He seems to be a very levelheaded guy who certainly isn't prone to exaggeration.

the problem is that you could never do what would have to be done: mass deportations, closing borders, investigations and detentions in the US muslim communities, with the judiciary in place as it currently exists. no way. that would be the problem, I don't know if phrasing it as "throwing away the constitution" is correct. the way I look at it, a large part of the judiciary currently seated on the bench has ALREADY thrown away the constitution, we have to take the country back from them.

I don't think that the Constitution would be scraped. I am sure however that Martial law would be declared, and would continue in effect for quite some time.
It is even possible that some of our freedoms and liberties would be curtailed permenently through Constitutional amendments, but I think that as time went by the country would begin to recover and return to normal.

After the Revoulution, Wars have always and everywhere in US History caused an erosion of freedom.

Does anybody doubt that in the event of a WMD attack they would declare Martial Law? Of course not. That would have to happen in order to avoid mass panic, the public executing the entire Muslim population, etc.
There will be other attacks here.
The question is when.
The amswer is when the anti American crowd,the environmentalists, the communists and socialists are successful in getting us to withdraw our troops from Iraq.
I did not mention the democrats because they are included each time one mentions anti-Americans, socialists and communists, environmentalists.
At the moment, they are too busy fighting us over there to concentrate on attacking us over here.
Each day every democrat politican prays to his or her gods or goddess that a nucular devise will be detonated somewhere in the Unites States. They only hope that it will not be where they are.
We are going to have fight them. We can fight them here or there.

General Franks certainly knows what he is talking about. Consider this: A nuclear bomb hits NY and DC (ala 9.11.01) killing millions. I doubt very much if much of the civilian leadership will be left to govern effectively and control the chaos that would issue from the horror, fears and anger of the people this country. So who will fill the leadership vacuum, probably a strong military leader somewhere in the US or outside of the country whose chain of command maybe left intact. But perhaps if we get very lucky and have a military leader with the same ideal as George Washington, after the country become stabilized again, we might get our constitution back. I'm a hopeless optimist.
I think someone might want to have him clarify his statements - undoubtedly martial law would have to be declared and most, if not all, civil liberties of course would be suspended. But permanently? Maybe.
The democrats and the IslamoFascists are absolute soul mates. The rats despise Constitutional Law as proven by their attempt to pack the courts with corrupt "activist" judges who are destroying our Constitutional protections. The IslamoFascists seek by WMD to bring our government down.
I agree wholeheartedly with Franks assessment.

I watched some constitutional scholars give testimony to a Congressional committee a few weeks ago about what the constitution says about the line of succession. They basically all said that this is a constitutional disaster waiting to happen. It has been addressed then changed a lot of times. But there's a lot of ambiguity there now. There could easily be a scramble for the presidency. Very frightening stuff.
