I specifically chose that title because I didn’t want to take the Lords name in vain...

Secondly, I think it’s ridiculous to say that because of the wording in a handbook that literally has little to do with actually purchasing a home, one should be discouraged from buying that home due to an HOA handbook. It is beyond ridiculous. Rules are meant to be broken and if they are wrong (which this one was) they should and can be changed.

(Please don’t make me use the slavery and womens suffrage analysis here...we get it. Things that are put in writing or are considered law can be changed if they are seen as gross misinterpretations of rights)

My father did ask the board for an exception and received it...and are now viewed by the community as exception neighbors and patriots rather than “bad neighbors” as you so eloquently put.

I might be able to offer a bit of info. on your question.
Membership may be part of the purchase agreement or deed. Buying the house is joining and agreeing to restrictions.
It's a nice scam for the developers. They sell a few lots and the buyers form an assoc.
When enough lots are sold an assessment is made to build a club house/community center and install side walks. The developer pays the assessment for the original assoc. members and gets a great selling feature at little cost to himself.
It's legal and enforceable in court.

I have the ‘contract’ memorized. I read the ‘rules’ before I moved here. The board ignores the rules. Yes, the articles of incorporation and By laws (the rules) says a 75% majority can change the By laws. They say 50% majority can dissolve the HOA. We have a 68% vote to dissolve, the board refuses, their atty says it takes 100%, it doesn’t , but they won’t budge without a lawsuit to force them to act. I can’t afford to win, as most people can’t. But we’re working on it. EACH state is different as well.

Don't dissolve the HOA. Get rid of the items you don't like so you don't wind up with a Pink house in the tract.

Isn't the Board made up of Homeowners? Get rid of the "Mr. Nasties" on the Board.

My Grandfather got on the Board.

Maybe talking to the Town Attorney will help you out. Good community relations help. Send your best!! which is not necessarily yourself.

All words are terms that represent things or ideas. “God” is a word (i.e. “term”) that represents the Almighty.

Are you being sarcastic? Maybe making light of my concern with the sacredness of God? Not sure why you’d do that, if that’s in fact what you’re doing, Laz.

We’re WAY beyond all that, but thanks anyway. And yes, I’m not the BEST, but there are 500 men in this HOA, and not ONE of them with the gonads to stand up to them. You do not understand the extent of my situation and to someone not understanding the mess some of your advice is just not relavant. I wasn’t looking for help. Believe me, there IS none. These HOA’s can do anything they want and unless you can afford to fight them in court, you lose. They have the entire ‘association’ funds available to them to fight you. Several have tried and been so wound up in court costs it’s bankrupted them. Fact. They won’t allow a legal campaign or election to run against them. Candidates are not allowed to state any positions on HOA issues in any literature, etc.

I do hope this is NOT the typical HOA, but there isn’t much stopping it. No, not the Atty. general of the state, NO, not the corporations commission....YES, I have an appointment with a lawyer tomorrow, just to throw away some more $$$.

I don’t agree with the banning flag policy being acceptable because he signed a contract with the HOA.

No purple paint, mow your lawns, don’t fix your car, don’t put up political signs, okay, MAYBE I will concede your point.

But not the United States flag. That, to me, is the one outstanding symbol of our country and the men and women who have died to bring us its justice, freedom and patriotism, and NO ONE should ever be able to tell anyone that they cannot fly it, in my opinion, regardless of where they live.

Personally, I feel the same way. However, by being a member of a HOA that reserves the right to ban such things (and I suspect they're banning flag poles, and not flags, which is a different issue entirely), the member voluntarily gives up his right to do so.

Its his right, to give up that right, regardless if I agree with it or not. Likewise, the other members of the HOA have the right not to see any flags, and not to see the U.S. flag in particular, if that is what they want. I don't like it, and I don't agree with it, but it is their right to live in an area with a HOA that regulates such things.

This is a voluntary agreement - one doesn't have to live in an area with a HOA, and one doesn't have to live in that particular HOA.

There are all sorts of agreements/contracts/covenants that free people enter into voluntarily where they elect to give up some rights in order to obtain some perceived benefit.

Free speech is routinely given up on a limited basis in lawsuit settlements. Free association is routinely surrendered on a limited basis in employment contracts. Free people have the right to make stupid decisions, and one of those is to elect to surrender portions of their liberty if they wish.

The word “GAWD” does not reference the Heavenly Father. The word “GOD” does. You were being much too judgemental and were, in fact, wrong.
