Judge Faces Removal, $40K Fine Because of Her Beliefs About Marriage

state agency wants to remove a small-town judge in Wyoming from two posts because she told a reporter that her religious beliefs would prevent her from solemnizing same-sex marriages.

In her full-time responsibilities, Municipal Judge Ruth Neely isn’t authorized to preside over marriages. In part-time duties on the local Circuit Court, though, she could be asked to do so.

Now supporters across Wyoming and the nation are siding with Neely as she asks the Wyoming Supreme Court to prevent the state Commission on Judicial Conduct and Ethics from ending her 21-year career as a municipal judge in Pinedale, a town with a population of 2,030 just south of Yellowstone National Park.

So far as I can tell, this is the Wyoming law:

20-1-101 Marriage a civil contract

Marriage is a civil contract between a male and a female person to which the consent of the parties capable of contracting is essential.

Wyoming Code - Title 20: Domestic Relations - Chapter 1: Husband and Wife - Article 1: Creation of Marriage (C.L. 1876, ch. 81, § 1; R.S. 1887, § 1541; R.S. 1899, § 2955; C.S. 1910, § 3891; C.S. 1920, § 4955; R.S. 1931, § 68-101; C.S. 1945, § 50-101; W.S. 1957, § 20-1; Laws 1977, ch. 152, § 1; Rev. W.S. 1957, § 20-1-101.)

"...a civil contract between a male and a female..."

As I recall, SCOTUS invalidated that.

If the present law, a definition of marriage, is invalid and hasn't been replaced by a new law, a new definition of marriage, how can anyone be legally married and how can anyone be punished for refusing to solemnize a marriage?

Haven’t had the issue here in Texas yet, but as a municipal court judge, I just don’t do weddings at all. Equal protection, don’cha know...

The members of that judicial commission are in the wrong state. They need to tread very, very carefully whenever they leave Cheyenne.
