There is one little word left out of the conversation...say it slowly and repeat after me-- "jurors". Yes, its your fellow citizens that continue to award these ridiculous judgements. Its the dumbing down of America effect. Any trial lawyer will tell you that the same case in two different venues will bring two very different judgements. Here in Atlanta, for instance, if you get a Fulton County jury (city of Atlanta) and a black plaintiff the insurance company better settle that case, pronto. Most of the Atlanta jurors have no idea how business works...to them its just a free pot of money. Why not give cousin, Demarco, another million or two. Take the same case thirty miles up the road to Forsyth County and the plaintiff better not take it to a jury (particularly if it is a soft tissue injury case). The same goes for jury nullification in criminal cases and the dumbing down of America. O.J.s case wasn't the only one....are the lawyers at fault here too? Had O.J.s case been tried near Brentwood, as it should have been, then we wouldn't all stll be looking for Nicole's killer. (sarcasm off)
