Probably because it turned out the material either did not portray minors engaged in sex acts, or it was impossible to determine whether minors were depicted or not. This is a real problem as these cases are prosecuted, many times it turns out the material is not true child porn. Other times the offenders are in possession of so much of it that it's not feasible to determine whether some of it is illegal.

WHY was this dropped? I would guess part of a plea bargain. The did get him for the more serious charge.
