Right and unenumerated simply protects those not covered in the 10th, if it doesnt then its decided by the judiciary as in Griswold v. Connecticut. Madisons intent was by enumerating particular exceptions to the grant of power, it would disparage those rights which were not placed in that enumeration. Its a simple concept even an eight year old can understand, its a right if theres NO legislative prohibition.
