Man strikes plea deal in rape of 15-month-old

A Strongsville man who faced life in prison if convicted of forcibly raping a 15-month-old girl and molesting her infant brother struck a plea deal yesterday and got an 11-year sentence instead.

Paul Kaforey, 38, pleaded guilty to one count each of rape and gross sexual imposition, but prosecutors dropped the indictment's claim that he used force.

The plea bargain came on the eve of a hearing to determine whether Strongsville police legally searched Kaforey's home when they seized evidence including videotapes and photographs of Kaforey engaging in sex with the girl and the boy, who was less than a year old.

Cuyahoga County Common Pleas Judge John O'Donnell handed down the sentence, and also declared Kaforey a sexual predator. That will require Kaforey to report to police every three months after his release.

Assistant County Prosecutor Michael Sullivan said the children's mother approved the plea bargain.

He faced life in prison and is now getting 11 YEARS! I have to admit, these kinds of stories infuriate me. Somewhere along the line, the legal system changed it's top priority from protecting the most vunerable among us to "rehabiliting" the sickos and developing new programs to integrate them back into the community. When the inevitable happens and the person who was put back into the community reoffends, then it was because the person did not get enough community supervision and the state gets sued, the integration program gets more money, another child is raped, and the "person" who commited this horrible crime is put into another program to get "rehabilitated" again. Our children's protection needs to be the first priority again. Yes, a consequence of steeper sentences for sex offenders may mean a few truely rehabilitated sex offenders stay behind bars longer than they would have otherwise, but fewer children would be raped. Would the law makers rather have fewer children raped, or more programs and offenders in the community. Sadly the answer is more sex offender programs and as an unavoidable result, more children raped. Sick!

Is there any other way to rape a toddler? Jeez, these people sicken me! By the way, why were these children 'in his care' in the first place?

How could raping a 15-month-old be anything BUT forcible? Are they implying that the baby agreed to it? I feel sick.

Perhaps you read the article headline then immediately hit the reply button? If the evidence was excluded, he wouldn't get a life sentence. He wouldn't get an 11 year sentence. He'd walk free. That's why he got the plea bargain.

Good point, I left that out of my rant. I wonder if there was just a small technicality regarding the legality of the search, or did the police just really screw up? Not enough information in this article to know.
Either way, this monster's actions are not in dispute and justice is not being served.

An 11 sentence is much prefreable to society than no conviction at all. What may have happen is the police conducted a warrantless search and the video tapes may have been excluded. Without that evidence the prosecutor may not have had a "case" which he or she might have been able to sustain a guilty verdict.

What comes around goes around. The folkes in prison read newspapers too and I suspect the Defendant will not be too popular in prison.

What is up with that?! There has got to be more to this story than what was reported here.

If you've ever been party to a case involving sexual assault on a minor, you'd understand that the trial is often an opportunity for a second rape, sanctioned by our legal system. The mother of these poor children has to do what's in their best interests, and I support her decision.

I do not believe they can be rehabilitated, but my state government does on some levels.

That is correct with the typical preferential sexual offender. I heard a lecture once where a psychologist explained why rehabiliting pedophiles doesn't work. She simply said this "Imagine a counselor taking YOU and trying to change your sexual orientation... no amount of drugs, therapy, etc, could turn an adult from a heterosexual into a homosexual, for example."

I think the only plea bargain he should have been allowed would be to choose hanging over beheading or drawing and quartering. Our courts are something else...

If someone raped one of mine, I'd hope he wouldn't be sent to jail. Some things, a father has to take care of himself. That being said, sexual predators should never be given a second chance.
