I think that you posted your #74 on the wrong thread, as it has no bearingon this discussion. Generally speaking, the duty (or non-duty, depending on jurisdiction) to retreat requires that you (or someone else) be in immediate apprehension of physical harm.

Referring to my post #74:

Please note that para C is italicized. This is the section which allows a citizen to search a detainee. The rest just happened to be on the page I C&P'd.
