In other words, the president has the power to reject, modify or ignore Army regulations at will.

Hundreds of foreign prisoners are in a holding facility in Guantanamo Bay, Cuba. All are facing indefinite detention and have no way to challenge the legitimacy of their imprisonment.

Interrogate and shoot the bastards afterwards. Then, there will be no imprisonment to challenge the legitimacy of.

Where's the beef?

Given that the prisoners are being treated as well as POWs (in accordance with the terms of the Geneva Convention even though we don't have to do so since they did not wear uniforms and have clear rank), the only reason to grant them the hearings sought by the original author would be to punish them more harshly.

Status tribunals have been routinely observed in other engagements without it being too cumbersome, Fidell said. "The administration would have been well served to hold hearings even if it had the winning argument... It would have... blunted the criticism both domestically and with foreign audiences," Fidell said.

So Fidell agrees with Bush on the legal merits. Meaning the author's "above the law" claim is false, since Army Regs can be modified by the Commander in Chief. And Fidell is merely pointing out that fewer pinko clowns would be criticising Bush if he took a softer stance. And no doubt fewer pinko clowns would criticize Bush if he took a softer stance on everything. Well F them.

These terrorists POWs are living the life of Riley compared to POWs taken in other nations..
They are being treated so well ...we are probably gonna have a hard time getting rid of them

Fortunately they will be so soft when they get home....they arent going to be too well received..by their bretheren...and if are released into the wild...they are just gonna go right back to their terrorists ways...and kill a few more of our kids...just like they were when they got captured/surrendered

Remember the POW they let go in Saving Private Ryan?....they saw him again to...and he was wiser and smarter and put his knowledge to use killing the ones who were so kind as to let him go..

Personally I think it was dumb to take so many prisoners...they should have sorted them out better in the first place..
