In this instance it clearly does not. They are talking about growing and distributing the plant within California.

Constitutionally speaking I think this is a clear violation of state's rights.

Well, you're just failing to see the penumbras. See, one of his customers could have crossed state lines and given the pot to someone else there. Or a customer might have bought pot for medical purposes from him instead of buying other medicine from out of state. Clearly it has a profound effect on interstate commerce.

Yes, this is total BS. It's also the federal government's official position, and for some reason the Supreme Court has generally upheld it.

Yeah, but they probably bought some of the soil from Washington, the watering can from Arizona, and some of the pollen could be picked up in the air and be spread to Nevada....
