I hope they do try.
We would easily have the votes in the SCOTUS. And attempting to do what is being suggested would cause a nationwide backlash they would feel at the polls this year in Missouri, Minnesota, South Dakota, Georgia, Iowa, Texas, and a whole bunch of areas where they can't afford a backlash.

Don't let your heart be troubled. The Democrats are going to lose this seat because of illegal behavior. If they chose to try and wage a baseless legal battle to keep it for another 2 years, let them try. That will only ensure that NJ will go for Bush in 2004 and have 2 Republican Senators in 2006.
