Example: I see a patient who has a brain hemorrhage and send him to the hospital to be seen by a neurosurgeon. Under the regs as written, the neurosurgeon could not even look at the cat scan without the patient's signed permission.....sheer stupidity.

Example, I find out my new insurance provider (United Health Care) is selling every detail of my medical history to credit agencies. To maintain my privacy I withhold my SSN. Result: I lose all coverage.

See how that works?

BTW, I argued for 30 min with a United Healthcare rep for one of my patients yesterday. Don't think I'm a friend of HMO's. I am just talking about these crazy HIPA regs.

If you know anyone in the DC area alert them to stand clear of the DC District Court building as they maybe endangering themselves when the FIOA of request comes flying in....

Our company just switched medical plans to another provider. They wanted my SSN to use as an ID and I refused. They asked for it later to look up previous records. Then, they gave me an alternate number for my patient ID. It was my SSN, backwards.

WOnderful.

This ruling doesnt allow your HMO to sell to outside entitities. It only allows doctors and hospitals to share medical information with other medical personal and with the HMO's and insurance companies that pay for the care. Your records are better protected today from outside sources than they were 10 years ago.

That is already illegal. Prosecute them. Quit implying something that is now illegal is Bush's fault because you do not try to get the current laws enforced. This situation that you give as an example would not be changed.
