"Bottom line" as I see it:

Free Republic pays nominal damages to plaintiffs ($10,000) and promises not to allow posting of material from publications owned by plaintiffs in future.

Conclusion: Huge victory for Free Republic. Considering that plaintiffs were originally seeking million dollar plus settlement that would have effectively ended Free Republic (at least as we know it).

62 pages ... lawyers behaving badly.

The time and expense allocated to this case by these giant media companies is absolute evidence, IMO, that the Post and Times were eager for an opportunity to get a legal opinion on the sanctity of their copyrights within this new, and very threatening, internet medium. It was a very important step in their vital mission to protect the value and control of their proprietary and revenue producing news products - accross many media properties - that use the World Wide Web for distribution. They NEEDED to win this one unambiguously. They NEEDED a pre-emptive legal strike that reaffirms the copyright protection of their unique, value generating news and entertaiment creations going forward. If Jim decides some day to commission, market or syndicate the considerable writing talents of Freepers (or formers) like JohnHuang2, Debo21, Coyote, Jeff Head, Dead, Iowa Hawk, Michael Wright, VictoriaDelsoul etc. to conservative internet news outlets or mainstream media vehicles, if RadioFR's value and influence is such that other outlets want to broadcast it, he'll be happy the copyright law is clear.
