If they're here illegally, there is no reason whatsoever to let them stay now.

This touches on something that has been bothering me. On FNC, they often talk with Judge Neopolitano (sp). And he always says that the authories can't detain suspects without reasonable cause, because of our constitution. My question is this.... If these people are NOT citizens of the US, then what rights do they have under our constitution? I would think NONE AT ALL. And that we could detain them until we felt like letting them leave or be deported whichever seemed best.

Could someone explain to me why non citizens, who may be here illegally are given access to our 'rights' as citizens?

If they cannot prove they are here legally, we have "reasonable cause" that they are violating immigration laws.
