The Eighth Circuit ruled that Missouri must use its 2025 congressional map in November, holding that switching to the 2022 map after the August primary violates the Constitution. The court ordered entry of a permanent injunction, but paused it for one week.
The court held that Article I, Section 2 protects voters’ ability to participate in the selection of congressional nominees. Switching maps after the primary would leave some voters choosing among nominees they had no opportunity to select.
The court rejected arguments that the Supreme Court’s stay or approaching election deadlines made the appeal moot. It reached the constitutional merits without further discovery or hearings, finding that the dispute presented a purely legal question
The court declined to decide the Equal Protection and Elections Clause claims. Its ruling rests on Article I, Section 2 and does not resolve whether Missouri’s referendum process may ordinarily suspend a congressional redistricting law.
The district court must enter a permanent injunction, but administratively stay it until September 28 at 5 p.m. Central to allow Supreme Court review. The Eighth Circuit ordered its mandate to issue immediately.
Judge Stras dissented in part, arguing that the intervenors lacked standing to appeal because their referendum remains on the ballot and they showed no personal injury from using the 2025 map. He would have dismissed the appeal without reaching the constitutional merits.

This appears to be a ruling of law and does not reference, so far as I can tell, who it favors. I’d hope someone would answer that as who among us is so familiar with the case that we’d know who it favors? Anyone know?
It puts SCOTUS in a shitty place. The cowards argued that Trump’s USPS voter verification is LIKELY to succeed on merits, but said it was too late in the election season to upset the apple cart now (after letting the liberal justices and liberal Courts delay it repeatedly) - and the 8th US Circuit is saying, “oh yeah, too late to upset the apple cart, then I guess you *HAVE* to ignore this appeal until *AFTER* the election based on your most recent ruling, don’t you?”
The 8th Circuit put SCOTUS in the bed they made. The only hope the appellants have is to say the 8th Circuit acted too late - but the 8th Circuit already said *that* about the appellants.

JD Vance directly called for this just days ago while in Missouri: “When you have courts that say that Missouri is not allowed to draw its districts the way that it would like to, but certain blue states are, what that means is that those courts are saying that the votes of a Missouri Republican or a Missouri Independent count less than a Massachusetts Democrat.”
“You could have people who are going in the general election and casting ballots in districts that are different than the ballots that they cast just a couple of months ago in the primary. That, to me, is an affront to the democratic process.”
Are people really not up on this? The 2025 map redraws Missouri congressional districts to favor an additional GOP seat. Not guarantee it - no redraws guarantee anything - but the likely result was an additional R from Missouri.
Democrats let election season - for a *2025* redraw - go all the way through primaries, then filed to overturn the redraw from the year before to get their seat back.

If I got the state correctly, they eliminated their 1 blue district by realigning two or three districts to the south and eastern of the blue district, and then merging the blue district into the two red districts. On balance all districts are proportional. Whether the formerly one blue district will be diluted enough to be outvoted remains to be seen. It could backfire and create two blue districts. Depends on turnout and how people vote overall - which is technically true in every district but since the state’s goal was to eliminate a blue seat - we’ll see.
That's not correct. A citizen group turned in a petition with the required number of signatures in early December, 2025. The group filed legal action after Secretary of State Hoskins waited months to rule (on August 4th) that the petition is void because congressional redistricting plans cannot be subject to voter referendums in Missouri.
Except that's not the case. The Missouri Supreme Court has ruled (once in dicta, once in a holding) that the referendum process applies to ANY act of the Missouri Legislature.
