The Brief
A federal judge in Maryland said she expects to rule by February on the fate of Kilmar Abrego Garcia, a Maryland man wrongfully deported to El Salvador.
Judge Paula Xinis is considering whether Garcia’s 2019 removal order became final last year, which could affect whether the government can re-detain him.
Xinis said her order blocking the government from re-detaining Garcia remains in effect while she reviews the case.
What we know:
In a brief 20-minute hearing with Garcia’s lawyers and DOJ attorneys, Judge Paula Xinis said she wants to hear arguments on whether Garcia’s 2019 order of removal became final in January of last year.
That could change the calculus of whether to allow the government to re-detain him.
Xinis said after she hears arguments on that narrow issue, she will issue a decision by February 12, barring unforeseen circumstances.
Xinis reiterated that her current order blocking the government from re-detaining Garcia for deportation remains in place.

The DemonRATS sent another female greek judge out the other day to screw over the American people. Can’t remember her name but it was definitely creek. I wonder why America women don’t qualify for these RAT owned “judge” positions.
Not only would they hear the challenges, but by displacing the immigration courts as the body that issues the deportation orders, they are putting state crimes out of their jurisdictions.
That means that ICE would no longer have any warrants to go to state prisons and jails to retrieve illegal aliens for deporations, because federal district court judges won't have the jurisdiction to issue them.

Garcia was not a ‘Mariland man’ he was an illegal alien from El Salvador with an order for his deportation on file.
And no, he was not ‘wrongly deported’ the order of deportation said he could be deported to any country, except Guatemala. DHS did not make a mistake. Later it was found out that the judge had meant to write El Salvador.
In any event it is a travesty that human trafficker is still in the USA.

Why is a federal magistrate ruling over an immigration issue? I thought they did not have authority over these issues.
Bondi made a grave mistake adhering to a crooked judge’s order to bring him back in the first place because she said she had enough evidence to convict him. Is she too naive to realize no amount of “evidence” will ever suffice to a leftist judge who wants to stick it to this administration?
The only good thing about this Kilmer guy is for all the resources the democrats, their media whores, the judiciary, his activist, and his free lawyers a hundred thousand others have been kicked out.
Surprised they didn't say "a Maryland father..." which the media often say, as if he is some kind of upstanding family man and citizen - and not a wife-beating, gang banging human trafficker.
