On what grounds would it not be legal ? Is it illegal to donate money to the general fund, as many are annually encouraged to do if they don't think they're paying enough taxes.

And who's going to challenge ? Not the current DoJ.

And, finally, would the current SC stop it ? No.

No, but it is a violation of the gift policy that any gift must be unconditional as to its use. There’s probably an “exception to policy” letter somewhere justifying the restricted gift.

the money was accepted under the department’s “general gift acceptance authority.”

Citizens can make a gift of extra money to the treasury. In this case, the (for now) anaonymous donor stipulated that the money be used to pay troops.

Barring a specific law that prohibits it, I would think it legal.
