The question is: In which direction?
So they’re not going to make a decision on birth right citizenship. They are going to issue a ruling on the narrow question of whether lower court judges can issue nationwide injunctions against presidential actions.
Then once they’ve made that decision, then the actual issue will be heard in lower courts, and eventually go to the supreme court.
Probably split another baby with a wishy washy decision.
Congress could do this tomorrow, with a simple majority vote.

This will be a good test of justices’ dedication to interpreting the Constitution itself, as meant at the time, as opposed to making the kind of compromise described by Horace Greeley in 1860, leading up to Civil War: ie, “another nasty compromise where everything is conceded and nothing is secured.”
Dear Lord, Cause them to make the right decision and restrict the judicial power to where it belongs. The heart of the king is as a river in Your hands and You turn it where You will. Turn the hearts of the SCOTUS towards righteousness and justice.
Who knows? But the good thing is Kagan was on film speaking out against the legality of nationwide injunctions. Now, she may completely flip-flop and ditch her previous convictions, but at least there is a chance she will be on our side on this specific issue.
5-4 with Roberts concurring with the 4 conservatives but writing as if he was part of the minority. It will be a narrow ruling to just the judge at hand.

Wake me if it actually breaks in favor of The Constituion.
From what some are saying, SCOTUS may find universal, nationwide injunctions are improper, BUT determine that birthright citizen ship is not ripe to decide because there were not full hearings at the District Courts. Hence, all TROs will be reversed pending full record at the trial court. Birthright citizenship will be kicked depending on how the lower courts decide.

This is the money shot, right here! Nationwide injunctions have never been tested in court and it’s hard to see how the textualists can do other than clip these judges wings.
It says so much that Congress isn’t lifting a finger to help Trump.
