He is an El Salvador citizen under the control of El Salvador. Maybe it was an error to send him there without going back to an immigration judge, but they have zero obligation to release their own citizen.

A person, unless a suspected/convicted criminal or needed for national service (military, etc.), has the international law right to leave his country.
