CHICAGO — Some Illinois state legislators are trying to make it legal for people who might appear to be having a mental health episode to attack police officers. But it would still be illegal to attack firemen like the one the bill’s chief sponsor is married to.
Rep. Lisa Davis introduced House Bill #3458 last month and picked up two co-sponsors yesterday: Rep. Kelly Cassidy, who represents parts of the North Side, and Rep. Marcus Evans, Jr., whose district includes parts of the South Side and adjacent suburbs.
If it becomes law, the bill would “[provide] that it is a defense to aggravated battery when the individual battered is a peace officer and the officer responded to an incident in which the officer interacted with a person whom a reasonable officer could believe was having a mental health episode and the person with whom the officer interacted has a documented mental illness and acted abruptly.”

Other than the trauma of the Buffalo Bills not beating the Chiefs in the playoffs, I disagree completely.
The writer of this legislation should be required to spend a week with a police officer on patrol. Then talk to police officers having to deal with whackos, nut jobs, and Chiefs fans.
No, it should not be made explicitly legal, however, DA’s and Judges should indeed take such matters into account when choosing whether or not to charge, and whether or not to punish.
A man having a psychotic episode, and fighting with a police officer during one should not be treated the same as a someone of sound mind deciding to do the same.
I’m not familiar with the content of this bill, and I don’t trust headlines at all. Hopefully this is a bill that adequately allows and requires discretion on these incidents, rather than well intentioned but harmful mandates.

I looked with just a modicum of effort, but didn’t see a party affiliation. But I can take a guess, based upon previous situations where a politician’s name lacks a (D) or an (R) appended to the surname...

Then you have be lucky enough to deal with one without violent tendencies if you believe only drug induced mental issues result in violence.
If you have ever had to deal with someone who does have mental issues that can include violent episodes, you can’t remotely believe that only kicks to the head, or drug or alcohol abuse can be the only cause of violence from mental issues.
If this law is about providing discretion at the DA and Judge level to take true issues of mental problems into account, then its a good thing... if its to codify something so say if having a mental episode for any reason violence cannot be prosecuted, then that’s wrong.
In a perfect world, DA’s and Judges would take into account real mental episode violence, vs conscious and deliberate intended violence. However, as we all know, common sense is a rare trait these days.
Once again, these people are trying to outlaw self-defense.
