Illegals are not citizens. The hell with bringing them before a magistrate. Bring them directly to the border and kicked their ass out. If that doesn’t work bring him before an immigration judge.

Sorry, bud - in Texas, every judge is a magistrate. They may not all perform magistrate duties, but we’re ALL magistrates.

In PA a magistrate judge is basically just a pleeb to help keep the real courts from getting clogged down.

Anything they rule can be appealed to the “real” courts.

“A magistrate isn’t a real judge, they are basically people who take a weekend course on the law in a hotel ballroom.

There job is to handle the little crap, like evictions, parking tickets etc... NOTHING they rule is binding unless the parties agree to it. EVERYTHING a Magisterial ā€œjudgeā€ rules can be appealed to the ā€œREALā€ courts, without any need to even have to present a reason for the appeal.”

You could not be more wrong: Nearly all federal magistrates are full time judges. They are appointed for eight years terms upon approval of a majority of the federal district court judges in the district where the magistrate judge will serve. Training is extensive and ongoing. In criminal cases, they handle arraignments, bail, conditions of release, and many other pre-trial proceedings. In civil cases, they are assigned to oversee all pre-trial proceedings including scheduling orders, resolution of discovery disputes, and non-dispositive motions (motions that do not resolve the merits of the dispute) — although in some cases, the federal district court will delegate the authority to the magistrate judge to “hear and report” dispositive issues subject to de novo review by the district court judge. In both criminal and civil court cases, magistrate judges can “hear and determine” the merits of a case by motion and/or trial with the consent of all parties.

I have a huge amount of experience litigating before federal magistrate judges in civil cases. They are often as good, if not better, than many federal court judges.

You may be right, in PA, a Magistrate is anything but a real judge.

Federal system they may be something else.

i am starting to think the abc reporter got his facts wrong

the illegal may have been in court for missing his hearing on the theft charge

ICE asked for a detainer

and the judge said no

Correct. State and local magistrates are a different breed. They are often part-time elected judges that are responsible for overseeing misdemeanors, traffic violations, small civil claims, evictions, etc. In many states, they are not required to have a law degree. Training may be nothing more than a few hours a year.

Cmon ICE - put his ass on a plane and sort it out later.
They must have been holding him in a city facility where the magistrate has the authority to release.

Here’s my suggestion. Split the migration effort into two phases.

Phase 1: Remove illegals from red states and those cities that are willing to cooperate with ICE. This will make the process flow smoother.

Phase 2: Now imagine all of the illegals heading for the sanctuary cities and blue states. The sheer numbers will shock these blue cities and state. Crime will soar and the cost to harbor the illegals will explode. It wont take long for the blue zones to come crying for help. But dont help them. Inform the blue zones that they are now at the bottom of the priority list. Let them know ICE will be able to help them sometime around 2027. The citizens of these blue zones will go bonkers and vote all these DemocRATS out of office. As Rahm Emanuel once said, “never let a crisis go to waste !”
