The beauty of the ‘insurrection’ charge via the 14th Amendment (in the eyes of those who wish to invoke it) is that it requires no charge or conviction of insurrection. Confederate officers and office holders were never charged with, let alone convicted of insurrection, but they lost the right to hold office nonetheless.
