Judge [Merchan] in Trump hush money case delays key ruling ahead of sentencing

The judge overseeing Donald Trump's New York criminal trial delayed a key ruling Tuesday on whether the president-elect's conviction should be set aside, according to correspondence between the parties.

Trump’s team wants the case dismissed, and the prosecution says it needs time to evaluate next steps now that Trump has been re-elected. The court has granted them a week's delay to provide their position.

In a letter to Judge Juan Merchan, prosecutors said they agreed with Trump's request for a stay to consider how to proceed given his new status as president-elect.

"The People agree that these are unprecedented circumstances and that the arguments raised by defense counsel in correspondence to the People on Friday require careful consideration to ensure that any further steps in this proceeding appropriately balance the competing interests of (1) a jury verdict of guilt following trial that has the presumption of regularity; and (2) the Office of the President," prosecutor Matthew Colangelo wrote in a letter to the judge.

This case will never go any further. I'm betting a higher court will overturn the conviction before it comes back in front of Merchan.

…the competing interests of (1) a jury verdict of guilt following trial that has the presumption of regularity; and (2) the Office of the President

What about the interests of the NATION?

Merchan is a cowardly man, he can’t take a stand on his political beliefs and go through with the persecution but also is not to afraid to just dismiss the case now that he knows Trump has won it all.

He will rightfully die the thousand deaths of a coward.

The case has no merit and Merchan should be impeached, disbarred and investigated for Federal election interference (it’s a real law, folks) along with outright corruption with respect to his daughter.

Tony Colangelo gets investigated, interrogated, and told he can spill the beans on Garland or end up doing 25 years for his own role.

So partisan hack Merchan is finally wising up and realizing that trying to railroad the incoming President of the United States is not the wisest thing to do, even if you are blinded by partisan hatred.

Delay? It should’ve been dismissed! OK they wanna play that game Trump’s got the power now so go after his daughter for the illegal fundraising she did on Trump‘s trial but press charges on her in a red state. New York is a pit of corrupt snakes! She illegally raised funds knowing that her father was in charge of the court hearing for Trump and she went and raised millions on the case for the cackling hyena. This bitch needs to go to prison! You know the saying show me the man and by Sunday I’ll show you the crime! Trump better get his AG to go after the criminal judge and his daughter!

This is the 3rd delayment. Trump can’t appeal until he is sentenced so he has something to appeal. No incentive to sentence him until he is out of office. Then it starts back for him again. There will come a day when he is no longer prez, then they will hound him until he dies.

"..a jury verdict of guilt following trial that has the presumption of regularity.."

HA! There was NOTHING "regular" about this trial, it was a SHAM.

Merchan was doing the bidding of the democrat party. A conviction is what they wanted and Merchan delivered for them. As such, Merchan will not go against the democrats’ interests and vacate the ruling. He’ll let somebody else dismiss the case and overturn the conviction. Merchan is loyal and party comes first. He worked too hard to overturn himself.

Turley’s take in several posts on X:

@JonathanTurley

The Manhattan case is delayed for a week. My friend Andy McCarthy has suggested that the delay could lead to a suspension for the next term. If so, that would hardly be welcomed by the Trump team. It would be a curious resolution to keep it unresolved...

...The other possibility is that in roughly a week, the court could dismiss the case. That would be warranted in my view. In any case, whatever the ruling, the ability of the Trump team needs to be able to appeal any case that is not dismissed. This case is riddled with reversible errors in my view. The one option that should be rejected, in my view, is suspending during the pendency of the new administration...

...reversible errors. I would be surprised if the option is suspension for the pendency of the coming term. It would produce the absurd status of a Damocles Sword dangling over the head of the president...

...Keep in mind that Merchan could sentence without any limitations on the movement or duties of the president. He could also dismiss a case that should never have been brought...

...The lawfare failed. Trump won. Time to return the attractions to their cages and call the circus to an end in Manhattan.
