One would think that not being able to obtain the bond was enough for an 8th amendment standing.

The fine was so excessive that it also violated Trump's due process and equal protection rights.

I would think so too, and have been wondering aloud here what he was waiting on. I think the answer is two-fold, first he is waiting to see if the fine is reduced, and then second, if it’s not, does NY actually act on it. If they don’t act on it, then there are no damages, which are typically central to claiming standing.

But I expect James will be very careful about what damages she invokes, anyway, if it gets that far, and will only institute liens, which won’t be immediately acted upon, verses full divestiture. Going full divestiture before the appeal is even heard would be a scorched earth approach, that would likely destroy them in the end in some way too. Or maybe they’re suicide bombers, and don’t really care.
