Former deputy independent counsel Sol Wisenberg said Fulton County District Attorney Fani Willis’ entire office should be disqualified from the state RICO case against former President Donald Trump.
Fulton County Superior Court Judge Scott McAfee said Friday he would rule within the next two weeks whether Willis would be disqualified following a hearing during which attorneys for Trump and other defendants outlined their argument for Willis’ removal from the case. Wisenberg said that the evidence against Willis was strong.

“I think it’s been a very bad week for the Trump-bashers, the get-Trump crowd, and it was a very bad day for them, the parts that I saw in the courtroom there in Georgia,” Wisenberg told Fox News host Laura Ingraham. “And I thought the argument by Harry MacDougal there that you had at the end was just very, very good, very strong, so I don’t see how she – even assuming that she isn’t kicked off the case, which I think she should be, the damage to her has really been severe and to her case.”

Willis and Wade testified during a hearing held Feb. 15 and Feb. 16 that their relationship did not start until 2022. Robin Yeartie, a former friend of Willis, testified that her relationship with special prosecutor Nathan Wade began in 2019, not 2022.

“The entire office should be taken off of the case, and that was one of the points Harry MacDougal was making there, that how many of the members of the D.A.’s office there signed off on statements and on pleadings that they had to know were not accurate,” Wisenberg said. “I think he was devastating there.”
“You know, Laura, I, no offense to my many friends who have done really good work in state prosecution offices, but I expect this kind of stuff from elected partisan D.A.s like Fani Willis and like Alvin Bragg,” Wisenberg continued.
Willis secured an indictment against Trump and other defendants in August over the former president’s efforts to contest the results of the 2020 election in Georgia, which Joe Biden won by less than 12,000 votes. Attorneys for co-defendant Michael Roman, a former Trump campaign aide, filed a motion for Willis’ disqualification on Jan. 8 alleging that Willis, who hired Wade as a special prosecutor to help probe and prosecute the former president, was in a romantic relationship with Wade.

Wade received over $650,000 in fees for his work on the case, according to Fulton County records, and reportedly earned $250 an hour while working on the case against Trump, compared to $200 an hour for John Floyd, a RICO expert, as of May 2023, according to billing records obtained by the Daily Caller News Foundation. Other documents obtained by the DCNF show that Floyd was initially paid $150 an hour.
“I would say to the Democrats, you should probably pick better Democrat operatives to run your lawfare next time instead of people like Alvin Bragg and Jack Smith and Fani Willis and [Letitia] James,” said Mike Davis of the Article 3 Project, who joined Wisenberg to discuss the hearing. “This whole house of cards is collapsing on the Democrats.”
McAfee needs two weeks for a decision. That bodes well for Fani.
He’s “negotiating” with her.
I read on another post that McAfee is running unopposed for re-election and the deadline for filing to run against him is in two weeks.
Her office is so corrupt that all charges against President Trump need to be dismissed. None of this “She and her office should resign” crap.
They are the poster children for reforming immunity for prosecutors. Conservatives have always railed about judges legislating from the bench. When a prosecutor seeks to expand a criminal statute beyond what the legislature intended its legislating from the bench. The prosecutor bringing the case should be held accountable and pay damages. Then it will stop. Enough is enough!

Based on his most recent appointments, McAfee owes his loyalty to the Governor, not the DA. Willis can't do anything for McAfee other than ruin his career. Kemp can appoint McAfee to the Georgia Supreme Court, which looks like the trajectory that McAfee is currently on.

1000% percent! You have a case that was brought solely because that its high profile nature gave Fani Willis, as DA, direct access and control of a very large budget. She used that direct access and control to choose her boyfriend to be prosecutor so that she could funnel that large budget to him which directly benefited her. There is no case.
Wisenberg and a guy named Robert Ray are the only 2 “tv Attorneys” i listen too. They know their stuff and call it like they see them. Laura Ingram has them both on, which is too bad, because she simply wont shut the hell up and let them talk. Hannity is still the worst, but she isnt far behind...
Would agree with you. Also, the State Bar has complaints filed...so they might chose to suspend Fani for some number of months. If you look beyond Fani...none on the staff seem connected to Biden WH.
I didn't really give my point much thought before now, other than compiling their side-by-side career paths.
People who say that McAfee is in the tank for Willis are giving her too much power. She may be the Big Fish in the small pond of Atlanta, but she's a small fish in the larger pond of Georgia.
At the state level, we have Governor Kemp who already appointed McAfee twice to increasing positions of authority after U.S. Attorney for the Northern District of Georgia Byung J. “BJay” Pak initially appointed McAfee as Assistant U.S. Attorney for the Northern District of Georgia.
If McAfee rules in favor of Willis and Wade on some narrow technicalities and let their conspiracy of fraud stand, he will be effectively throwing away the rest of his reputation and legal career.
If McAfee makes the bold ruling and calls out what is clear to everyone else, he will secure his place in the Georgia judiciary. I believe his next career move will be an appointment to the Georgia Supreme Court by Kemp.
McAfee will be pilloried by the left, but the right will say it was the day that lawfare died. The one-two punch will be SCOTUS ruling for President Trump on the 14th amendment cases and McAfee ruling to remove Willis and Wade from their RICO case against Trump.

More raw accusations against the tarnished Fani.
From what I’ve heard from Phil Holloway, she was getting support in that race from a lot of citizens who were desperate to get rid of the former corrupt DA. She was also portraying herself as a moderate. Holloway himself supported her and he’s a conservative Cobb County lawyer.
As far as the two week window McAfee declared, it could be that he’s delaying the verdict due to the fact that the window for an opponent to file in his race is up in about two weeks. Right now he’s running unopposed. A negative ruling might not go over well in Fulton Co.
